The next-generation video codec Versatile Video Coding (VVC) (H.266) offers significant technical advantages over its predecessors HEVC (H.265) and AVC (H.264) and competitors (eg, the proprietary codecs AV1 and VP9). Finalized in October 2020, VVC can achieve the same level of perceptual quality as prior video codecs with up to 50% improvement in video coding efficiency, supporting 4K and 8K ultra high definition and high dynamic range. The standards designers created it from the ground up with new applications in mind, hence versatile in its name.

These performance gains come at an opportune moment, as the centrality of efficient video encoding in modern life grows ever more apparent. A study by Ericsson released last year forecasts that, even as total mobile traffic worldwide is set to quadruple by 2026, the proportion of that traffic for which video accounts will grow from 66% to 77%, assuming that the industry employs efficient compression technology.

Several factors feed into this explosive growth in transmitted video. For the first time, billions of people will have access to high-speed internet and video streaming. Global lockdowns due to covid-19 have drastically increased the prevalence of video streaming and conferencing. In addition, several new use cases for video are on the near horizon, including 360-degree video gaming applications, remote control over manufacturing machines and robotics, and healthcare applications (e.g., remote surgery).

VVC was designed to meet the worlds demands for efficient video compression and support a variety of new applications. However, to unlock VVCs potential, industry must account for thousands of SEPs. Patent holders will, in many cases, request royalties for these, and the royalty cost of implementation may play a role in the adoption rate of VVC.

Recognizing both the value of speedy uptake of VVC to worldwide commerce and development and the potential obstacle that an opaque or excessive royalty regime could pose to this goal, interested companies formed the Media Coding Industry Forum (MC-IF) in 2018. Since MPEG-LAs MPEG-2 patent pool began in the 1990s, video codec implementers have grown accustomed to obtaining all or most of the patent rights that they need to implement a codec through pools. Three patent pools serve VVCs predecessor HEVC, and many contend that this plurality has impeded HEVCs use. Accordingly, among MC-IFs ambitions was the fostering of a single, dominant patent pool that would offer all or nearly all the patent rights that an implementer would need for a single price. As MC-IF has stated in recent press releases, the organizations membership, which now comprises 49 companies, did not align on a single pool administrator. Two participants in MC-IFs pool fostering process, MPEG-LA and Access Advance (formerly HEVC Advance), intend to launch separate patent pools for VVC.

Nevertheless, a VVC licensing regime with broad industry support remains possible as video codecs have launched with multiple pools historically. For example, MPEG-LA and Via Licensing offered separate pools for the 2003-finalized standard AVC (H.264) presently the most widely used codec. With HEVC, the licensing ecosystem has become more stratified. Figure 1 displays the members of the three HEVC patent pools HEVC Advance, MPEG-LA and Velos Media. Another licensing administrator Sisvel offers implementers of the VP9 and AV1 codecs licences to some SEPs that are also licensed to HEVC implementers in other pools.

With a choice of VVC pools to join, SEP owners and implementers alike should consider the depth and strength of one anothers SEP portfolios. Complicating this effort is the fact that the universe of VVC SEPs is unknowable thus far. The patent declaration data for VVC promulgated by the standards body ITU-T and the consortium Joint Video Experts Team (JVET) is incomplete, as ITU-T does not require SEP owners to identify specific patents as essential. Indeed, as of March 2021, just 23 companies had filed declarations of VVC-essential patents with ITU-T, which is less than half of MC-IFs membership.

One approach to identifying VVC technology leaders is to analyze the involvement of companies in the development of the VVC standard. This approach assumes a correlation between a firms apparent influence on VVC and the strength of its VVC SEP portfolio. JVET is contribution-based, which means that member companies can submit technical proposals for inclusion in the standard on approval by the membership. The resulting final VVC specifications have thus been reviewed by all participants in VVC standardization a significant cross-section of all global video compression expertise. As the experts usually work for companies in competition with one another, JVET is both collaborative and competitive.

Meaningful, convincing contributions require considerable research and investment. Regular participation in standards setting tends to accord a company credibility in JVET, which in turn allows such a company to position its own technology for inclusion in the standard. The counting and analysis of approved standard contributions is therefore one measure of how much share and influence companies have in the development of a standard such as VVC.

Figure 2 shows the top companies that have submitted approved VVC standard contributions. Here, the IPlytics Platform database gathered more than 8,000 thousand VVC contributions, out of which only about 1,100 VVC contributions were identified as incorporated in the final VVC standard (as of March 2021). Qualcomm leads the VVC contributor list, followed by Huawei, ByteDance, Sharp and MediaTek. Of the top five companies, ByteDance is the only one that was not involved with the development of VVCs predecessor HEVC. Other new contributors for VVC include the China-based companies Alibaba, Kuaishou and Hikvision, as well as Korea-based Wilus Group. When looking at figure 2, some of the listed companies belong the same parent company as in the case of eg Sharp which has been acquired by Chinese Foxconn, both listed separately.

Figure 2 is not a definitive listing of parties with VVC-essential patents. In fact, of the declarations of VVC-essential patents on file with ITU-T, several declarants are not listed here as contributors. This could reflect the collaborative and iterative aspects of standards setting, where one participants technology may wind up in contributions by another because it independently came up with similar innovations or because of informal sometimes unattributed collaborations. In any event, the statistics provided herein are a good starting point for understanding which firms are likely to have essential patents and the relative depths of their portfolios.

Efficient video compression is critical in many respects to ongoing economic advancement worldwide. The bulk of video currently transmitted over the internet is encoded using the 2003-finalized codec AVC, and we are approaching the upper bound technologically of what that codec can provide. VVC is poised to meet industry demands for video compression going forward.

With widespread deployment of VVC will come the issue of licensing VVC SEPs. Senior patent counsel and standard managers should bear the following in mind about VVC patents:

1. Future technologies that enable video will increasingly rely on patented technology standards such as VVC.

2. Patent directors should not only consider information retrieved from patent data, but also monitor and consider patent declaration data, claim charts, patent pool data as well as standardization data (eg, technical contributions) to understand the landscape of VVC patent holders.

3. VVC like other video codecs will be deployed worldwide, meaning that the value and enforceability of its SEPs will be considered by a variety of jurisdictions. Senior patent managers should bear in mind that the law surrounding enforcement of SEPs continues to evolve worldwide, with potential implications for any firm selling standard-implementing technology.

4. VVC was only finalized in July 2020, meaning that many patent applications disclosing VVC-essential technology have yet to issue. The number of VVC SEPs is therefore constantly rising. Also, VVCs designers intended for the standard to be useful for new, even unforeseen, use cases.

The Tidal Basins beloved cherry blossoms are drowning. Twice a day at high tide, brackish water from the Potomac River floods the banks, plunging the walkway and the roots of its 3,800 cherry trees into standing, salty water. The culprit: climate change. As sea level in the Washington area continues to rise faster than anywhere else on the East Coast, the land itself is sinking, the byproduct of a prehistoric ice sheet melting and causing nearby ground to settle. Ongoing development, meanwhile, is causing additional runoff to the Tidal Basin. Leaving the trees and memorials to weather current conditions without intervention would thus be a death sentence for one of DCs most celebrated sights. As it is, only 4 percent of the 3,020 original trees given to Washington by the Japanese in 1912 remain.

If nothing is done, it is reasonable to anticipate that in somewhere between 50 and 100 years, the place will be under water, says Tidal Basin Ideas Lab co-curator Thomas Mellins.

Two years ago, the National Trust for Historic Preservation, the Trust for the National Mall, and the National Park Service launched a design challenge called the Tidal Basin Ideas Lab, inviting five US landscape-architecture firms to pitch proposals to save the historic site, or completely reimagine it. The idea was to initiate a conversation and jump-start options for the Park Service to consider, as well as generate excitement among donors who could help fund the future.

These are the results.

The firm that designed Manhattans High Line proposes multiple options, the boldest of which begins with surrender. Like a tale of biblical beginnings, the Tidal Basin is left to flood, allowing the memorials to weather the waters. A new elevated walkway mirrors the current loop of trees, albeit from a different perspective. A less extreme plan reworks the landmass around the monuments, allows for partial flooding, and eventually transforms the area into a series of islands. Visitors are still able to explore the Basin via boats and boardwalks connecting the archipelago.

A Critics Take: Most of the buildings on the Mall are less than 100 years old, and we manage to keep them in pristine form. The firm that designed the grounds of the National Museum of African American History & Culture wants to move slowly. Rather than redeveloping the landscape, the architects introduce incremental change over the next 70 years. Repairs to the existing floodgates (and later replacement) protect the land, and the creation of floodplain forests helps slow the flow of water. Native flora is introduced over time, ultimately replacing the cherry blossoms and creating new space for visitors to explore via marsh boardwalks.

A Critics Take: Its not a one-size-fits-all design. Its suggesting that we need to keep being ready to adjust. And nature can help show us a way. Headed by Walter Hood, a Black architect who edited an essay anthology calledBlack Landscapes Matter,this studio suggests different scenarios in graphic-novella form, each embedded with educational experiences about Black history and African Americans intimate connections to hush harbors: wetland havens where enslaved people met to worship. In one iteration, new floodgates regulate the flow of the Potomac and the fortified trail is enhanced with a narrative about the harbors. A different plan features an elevated track encircling the basin path and providing access to the monuments across the marsh. A third scenario calls for cherry trees in what is currently the south lane of Independence Avenue and the playing fields of West Potomac Park, raised up and away from the water line.

DLANDs solution is relatively straightforward: Create more terra firma to absorb water and provide alternate pathways to the monuments, dispersing foot traffic from the trampled tree roots. The MLK Memorial is moved to an elevated jetty across from Lincoln, creating a new plaza space framed by relocated cherry blossoms. Runoff from the Mall is collected in an ellipse pool within the basin, generating a reflecting-pool-type experience. A newly formed land bridge helps absorb water and extends from the White House axis to Jefferson, creating a direct pathway to access the monument. A green wall behind it forms a protective barrier to safeguard the monument and trees.

A Critics Take: This idea of moving some of the monuments is very intriguing, and very disturbing at one level, but it does show that there could be new relationships amongst monuments. The firms approach relies on intertwining pathways. Visitors can choose their own adventure, strolling down the cherry walk, marsh walk, and monument walk for a different experience on each trail. Pathways intersect at an elevated landmass and pedestrian bridge dubbed Independence Rise, protecting the uplands from the tide. The cherry walk, the path farthest up on the newly formed hills, mimics the classic circular route. Meanwhile, the monument walk links Jefferson, FDR, and MLK for ease of passage, absorbing some of the traffic that could otherwise trample the trees. The seawall becomes a pathway of its own along the marsh, with stepped terraces overlooking the basin.

Its an open question. The design challenge wasnt a contest, per se; it was more of a gambit, meant to provoke big thinking among stakeholders and those who may be inspired to play a role. The next steps lie with the National Park Service and a cohort of public commissions that get involved whenever federal land is involved. NPS will launch a master-planning process this year, during which themes from the proposals will be considered. Its possible that none of these exact visions come to fruition and that instead they help generate new ones. Either way, the hope is that the creative challenge motivates donors inclined to leave their mark on the area. Any effort will require monumental funds: NPS estimates that $500 million is needed in deferred maintenance alone.
