TALAMBAN Barangay Captain Dario Arcilla faces a criminal case in court for issuance of a cease-and-desist order (CDO).

He was indicted for allegedly usurping the authority of the Office of the Building Official (OBO) when he issued such order to stop a house construction early last year.

As a barangay captain, he had no authority to issue a cease and desist orders, as this is not among the powers and duties vested in him, read the disposition of Cebu City Assistant Prosecutor Leah Cruz indicting Arcilla before the Municipal Trial Court in Cities for usurpation of official functions for issuing the CDO against the construction of the house owned by Beltran Rizon.

Cruz recommended a bail of P10,000.

In 2012, Rizon filed a complaint against Arcilla for violation of Article 177 of the Revised Penal Code for usurpation of authority and grave abuse of discretion before the Office of the Cebu City Prosecutor.

Brother

Dario is the brother of Cebu City Councilor Alvin Arcilla.

In his complaint, Rizon said he planned to construct a residential house in Sitio Nasipit, Barangay Talamban.

He applied for barangay clearance but claimed that former village chief Jesus Remedio Jr. failed or refused to issue one.

Rizon then inquired from OBO in Cebu City whether he could proceed with his application for the building permit without the barangay clearance.
