THE barangay captain of Apas, Cebu City is appealing to the court to verify the ownership of the two contested lots in Sitio San Miguel before it pushes through with implementing the demolition order on March 4 against 157 families living in the area.

He is also asking the court to verify the families covered by the notice of demolition, as there are some who are not supposed to be on the list.

In an interview yesterday, Apas Barangay Captain Ramil Ayuman believes the court should first resolve the real owner of Lot 947, with an area of 7,411 square meters, and Lot 942, with an area of 9,753 square meters.

List verification

While the court already ruled that the lots are owned by Aletha Suico-Magat, Ayuman said they have new evidence that shows these are owned by the Province.

He was referring to Executive Order 20 issued on June 9, 1918 by the Office of the Governor General of the Philippines, which provides that Lot 947 and 942 are owned by the Province.

Ayuman said they also have a copy of the Friar Lands Sale Certificate issued by the Department of Environment and Natural Resources Office-Office of the Community Environment and Natural Resources Office on Sept. 3, 1919, which shows both lots are owned by the Province.

Aside from addressing the issue on ownership, Ayuman wants the court to determine who will be covered by the demolition.

Based on the notice of demolition sent by the Municipal Trial Court in Cities Branch 6, Ayuman said the list includes families who reside in other lots in the sitio.

Para nako, i-resolve sa gyud ni tanang issues. Nganu ipadali man ang pag-demolish? Daghan mang pamilya maapektuhan ani. Mao lang na akong panawagan (All these issues should first be resolved. Why rush the demolition, especially when many families will be affected? Thats my concern), he said.
