SOUTH BEND - An ordinance in the city of South Bend that mandates residents pay for the removal of trees on their tree lawn is raising concern. Property owners in South Bend are expected to pay anywhere from 400 to 1,500 dollars for the removal of hazardous trees.
Regina Hankins, a single mother of two, has been living in South Bend for 26 years. Last month, Hankins received a notice from the city requiring her to remove an Ash tree located on the tree lawn in front of her house.
"It's ridiculous to have to cut down a freaking' tree that you didn't even plant" says Hankins. Not knowing what to do, Hankins turned to District 3 Councilwoman, Valerie Schey, for help.
Schey believes the city needs to evaluate their budget priorities to make the city's residents number one. "While we continue to spend quite a bit on revitalizing our downtown, I worry that we are doing so at the expense of our residents" says Schey.
Director of Communications for the city of South Bend told FOX28 "We welcome further discussions about this issue during the budget process and we will work to keep residents informed of the longstanding municipal code that makes trees on their property, including tree lawns, the responsibility of homeowners. As well as, the city's tree removal program."
Schey however, believes the city should be doing more for their residents, especially when tax money pays for city upkeep. "I don't think that you can turn a blind eye to the residents who are essentially footing the bill for all that" says Schey.
The ordinance has been in place since 1962 and in fact states that property owners are responsible for removal of trees on their property - including the tree lawn. To read the entire ordinance follow this link and click on section 19.
The city also says residents can call the City Forester or parks department to discuss possible removal payment plans or go through a private tree-removal service. However, they say a private service may cost double or even triple what the city is charging.

CULPEPER Tree removal work will close the southbound right lane on Route 29 (Seminole Trail) in northern Albemarle County today from 9 a.m. to 3 p.m.
During this period, a contractor of Dominion Virginia Power will remove a dying poplar tree
located between Route 1719 (Towncenter Drive) and Route 1520 (Hollymead Drive).
Motorists should keep left and expect minor delays during work hours.

The site also has live traffic camera images for many major highways, including Interstate 64, I-66 and Routes 29 and 250 in Central Virginia. Motorists can call 511 from any telephone in Virginia for road and traffic conditions on all major highways in the state. This summer has seen an exponential growth in ash trees infested by the emerald ash borer on both public and private property in Lake Forest, according to City Forester Peter Gordon.
Since June 9, part-time forestry section staff have identified 1,780 ash trees on public property, with 1,172 tagged for removal on side streets, 573 tagged for removal on main roads, 145 in West Park and Northcroft Park, and 35 tagged in parking lots.
Another 142 ash trees were identified along Waukegan Road and five along Townline Road, both state roads owned by the Illinois Department of Transportation. Their removal is the responsibility of the state, Gordon said.
On private property, city crews have tagged another 3,702 ash trees.
These trees pose a threat to the public health or safety or public properties, Gordon said in his report to the City Council at its meeting on Sept. 2.
Figures show the city budgeted $200,000 in fiscal year 2015 for removal of damaged ash trees, with nearly 1,500 to be removed in all by a contractor, which is doing the bulk of the work, and city crews.
Removals are less than half completed and are far outpacing money available, Gordon said.
Removing trees that are hazardous and dead will continue to be the main focus, followed by removing trees on main roads and then side streets, he said.
To reduce contractual costs, the forestry section is attempting to remove 600 infested ash trees a year.
At the same time as the ash-tree removal is taking place, the city like other municipalities has to deal with diseased and dying trees of other species.

LEMONT An informal tree survey by theLemont Park District determined that about 507 of its 1,288 trees have been affected by the emerald ash borer, according to a park district news release.
Northview Park on McCarthy Road and Centennial Park on 127th Street have been most affected.
According to the release, a majority of the trees in the two parks most affected were not planted as part of a landscape plan but self propagated over time.
The park district will have to remove 182 trees from Northview Park, which is first on the list for tree removal.
Director of Maintenance and Planning Dawn Banks said the Northview Park tree removal is expected to cost $9,800 and should start in a couple of weeks, weather permitting.
The rate comes out to about $54 per tree, on average. By comparison, the Village of Lemont paid about $205 per tree, on average, to remove 252 ash trees on parkways in two subdivision.
Banks and Lemont Public Works Director Ralph Pukula said the smaller size of the park district trees and more concentrated area the trees will be removed from were part of the reason the park district paid less.
While the staff is working on a tree replacement plan to fit into future budgets, the immediate concern is removing the dead trees, according to the release.
With the number of dead trees in Northview Park and the age of its playground, the Lemont Park District Board and staff will work on a new master plan for renovating the park.
The process, which is expected to take about two years, will include various planning meetings, design research, budget consideration and a bidding process before construction starts.
