    Vernal real estate broker stripped of license, fined $75,000 - January 28, 2014 by Mr HomeBuilder

    VERNAL An award-winning real estate broker has been stripped of his license by state regulators and fined for forging termite inspection records and other documents needed to obtain Federal Housing Administration loans.

    The Utah Real Estate Commission revoked Kyle David Ashworth's broker license earlier this month and ordered him to pay a $75,000 fine.

    "The commission appreciates the Division of Real Estate for bringing this case for action, despite Mr. Ashworth's attempts to evade regulators," Commission Chairman Kay R. Ashton said in a statement announcing the sanctions.

    "Kyle Ashworth's criminal activity was very concerning as a risk to the community, so swift action against his license was necessary," Ashton added.

    Ashworth was sentenced in November to serve one month in the Uintah County Jail for his convictions on eight counts of forgery and six counts of communications fraud, all third-degree felonies.

    Ashworth, 31, forged the signatures of two developers, as well as the signature of a pest control company owner on documents sent to mortgage lenders to obtain FHA loans for prospective buyers, according to court records filed as part of his guilty plea.

    The forgeries took place between February 2011 and September 2012, according to Vernal police, who investigated the case along with the inspector general's office for the U.S. Department of Housing and Urban Development.

    Ashworth was initially charged with a combined 53 felony counts of forgery, communications fraud and engaging in a pattern of unlawful activity. As part of a plea deal reached in August, a judge dismissed 38 of those charges at the request of prosecutors.

    In 2012, Ashworth was named Coldwell Banker's top sales agent for its affiliate offices in Utah. He is also a recipient of the Uintah Basin Board of Realtors Presidential Award, and for the past two years has been the public face in the Uintah Basin of the Vernal Towne Center a 26-acre retail project being built by Gardner Development, the same firm behind The Gateway in Salt Lake City.

    Court records, however, show the forgeries Ashworth committed were all related to residential properties. None of the homes have experienced problems with termites, and all have now undergone "appropriate termite treatment," according to Ashworth's attorney.

    ATLANTA, Jan. 16, 2014 /PRNewswire/ -- Chicago tops the 2013 Bed Bug Cities List, released today by pest control leader Orkin. The Windy City's bed bug problem was serious enough that the City Council passed an ordinance in July 2013 requiring condo associations to have a formal management plan in place for the detection, inspection and treatment of these pests.

    In the South, two major cities had the biggest jumps on the list from 2012 to 2013-- Nashville moved up 17 spots while Charlotte climbed 18 spots. Other cities that made notable leaps up the list include Champaign/Springfield, Ill., Pittsburgh and Greenville/Spartanburg/Asheville, S.C. On the other end of the spectrum, Omaha, Neb., Colorado Springs/Pueblo, Colo., Lexington, Ky. and Buffalo, N.Y. settled into significantly lower spots on the list than last year. Of the five new cities on the list, three are in the Midwest Toledo, Ohio, Peoria, Ill. and Davenport, Iowa/Moline, Ill. New Orleans and Kansas City took the final two spots on the list as new entries. On the east coast, six cities took positions lower on the list, including three cities in New York-- Albany, Buffalo and New York City.

    Bed bugs continue to bite their way across the country as evidenced by the more than 20 percent increase in Rollins', Orkin's parent company, bed bug business compared to 2012. The nationwide resurgence of the bed bug population prompted the Centers for Disease Control and Prevention (CDC) and the U.S. Environmental Protection Agency (EPA) to release a joint statement in 2012 advising the public of the emerging health issues associated with bed bugs.

    "While studies show that bed bugs do not spread disease, the physical and mental health consequences are well documented and of serious public concern," said Orkin entomologist and Technical Services Director Ron Harrison, Ph.D. "Once bed bugs are inside your home or business, they can reproduce quickly and can travel from place to place in personal belongings and even on people. They can also move from place to place on their own, independently of objects."

    Because every bed bug scenario is different, it's important for homeowners to call on a professional who can create a solution tailored to their home's needs.

    The list released by Orkin ranks the cities by the number of bed bug treatments Orkin performed from January to December 2013, along with any shift in ranking compared to January to December 2012.

    Someone asked me if bugs will be out early because of the mild weather and what they should do about it.

    As I said in a previous column, you should take time to pest-proof your home in the winter before pest activity starts. Inspect your home or business around the outside and seal or screen any openings where bugs as small as ants can enter. Make sure you dont have any tree branches touching your home or business, as insects will use the branches as an avenue to find openings on the roof.

    If you have a pest control service, that is fine, but dont let them spray pesticides unless you have a bug infestation. Spraying pesticides to prevent pests is not a good practice and good companies dont do that.

    It is a good time to get your home inspected for termites as they are active all year and will be swarming in four or five weeks if the weather doesnt change much. Make sure whoever you use to inspect is familiar with drywood termites and other wood-destroying insects, as well as with subterranean termites. If you get a termite inspection, try to find an inspector who doesnt do treatments so there isnt any conflict of interest.

    If you have a commercial business, all you have to do is keep your facility as clean as possible and pest-proof it as you would your home. If you hire a professional, pick one that will inspect your facility but not use any toxic pesticides unless a severe infestation is present. Believe it or not, all commercial establishments can control their own pests if they want to. I know many business owners cant be bothered doing their own pest control work and that is fine. There are several real-good companies out there to help you.

    If you want to do some pest work yourself, then keep a pest control company available in case you get a sudden infestation of some pest. In commercial businesses this occasionally happens as vendors can bring in pests, as can unusual weather and other factors. You dont need anyone just coming in and spraying pesticides along the baseboards. That is not good pest management.

    With good common sense and a little knowledge, you can safely and effectively manage pests in your facility, even if its a restaurant, without anyone spraying toxic pesticides.

    If you have a hotel or motel, you can actually control bed bugs if they show up. You dont need to pay a fortune to have a room sprayed with toxic pesticides.

    Some companies use safe products and try to find one of these companies if you want, but you can do it yourself if you prefer. One problem pest companies have is the rules. They are not allowed to use any products, no matter how safe, unless the products are registered with the New Mexico Department of Agriculture. They cant use such great products as peppermint essential oil because it isnt technically a pesticide. Or grits, even though grits are great at ant control.

    However, homeowners and business owners can use anything they want in their home or business, as they wish. The general public has more options on what they can use to manage pests than the pesticide industry does. The industry is basically restricted to pesticides, while you as a homeowner or business owner can use diatomaceous earth, peppermint essential oils, cedar products, grits and many other safe and effective common products.

    Every year between January and July, termites swarm different areas of the country. They start in Florida and work there way up. During these first few months termites are active. But between the months of March to mid June these insects come out in severe swarms. All states are affected to an extent but the farthest northern states like north and South Dakota and Wisconsin do not have any severe swarming. These swarms can be determined by hot weather and rainfall in each individual area.
