    BELMAR Housing for a yeshiva in Belmar is considered a dormitory and is subject to New Jerseys fire safety codes implemented after a deadly blaze at Seton Hall University more than a decade ago, an appellate court has ruled.

    In a case that has been brewing for eight years, the decision by Judges Mitchel Ostrer and Garry Rothstadt upholds fines levied against Belmar Property Holding Co. LLC for its failure to install automatic fire suppression systems in buildings housing students attending a private Hebrew school in Belmar.

    The court, in its 21-page unpublished decision issued Friday, also noted that a change in ownership of the dormitories does not absolve the new owners from correcting the violations.

    The court battle grew out of an inspection by the state Division of Fire Safety in 2006 after the Belmar Fire Department responded three times that year to fire alarms at three dormitories serving the Mesivta Keser Torah of Central Jersey.

    From that inspection, division officials said the buildings converted houses on Twelfth Avenue and on C Street were dormitories and needed automatic fire sprinkler systems.

    New Jersey passed a law in 2000 requiring certain student housing to have automatic sprinkler systems after the death of three Seton Hall University students in dormitory that had no sprinklers.

    A month before a scheduled reinspection, the school and its rabbi, Dovid Heinemann, transferred title of Masivta Keser Torah to Belmar Property and Or Meir, the sole managing member of the holding company in December 2007, according to court papers.

    In January 2008, the buildings were inspected again, and they failed again for failure to install an automatic fire suppression system, according to the court documents.The state fined BPHC $500 for each of the three properties not in compliance and the holding company appealed the matter to an administrative law judge, who eventually upheld the states findings, according to the court documents.

    In arguing its case, BPHC attorneys contended the houses were not used as dormitories and the yeshiva is not a school that fell under the requirements of the state fire safety codes. They also argued that the residences, which were a couple blocks from the yeshiva on Eleventh Avenue, could not be considered dormitories because they were not on the schools grounds. They contended off-campus housing covered under the new regulations applied to fraternity and sorority houses.

    Why sprinkler systems are a sound idea in rural homes was made evident during a demonstration held Friday at the Essa Agri-Plex, southwest of Barrie.

    Dozens of fire officials from across central Ontario attended a side-by-side burn demonstration, hosted by the Essa Township fire department, to showcase the value and effectiveness of residential fire sprinklers.

    Two buildings, each the size of a large garden shed with one wall removed, contained a couch, a fresh, natural Christmas tree and a few other items. One shed had a sprinkler system, and one did not.

    Fire crews stood at the ready and the unprotected shed was torched. While its working smoke alarm sounded, flames continued to spread and within a minute or so, there was a ball of flame almost the size of the interior with temperatures in the ceiling reaching approximately 1,000 degrees Fahrenheit. The natural tree was badly scorched but the rest of the interior was blackened and burned.

    The sprinklered shed was later ignited and with its sprinklers, was barely damaged.

    "We believe that residential fire sprinklers benefit all home owners," said Essa Township Fire Chief Cynthia Ross Tustin. "Our initiative is aimed at educating everyone about their benefits and, in particular since there have been improvements in technology, highlight the fact that they are now a reasonable, viable option for property owners who are not connected to a water supply.

    "Modern building materials and today's household goods have drastically reduced the time families have for getting out safely in the event of a fire," she, noting that laminated beams and flooring, veneered cabinets and synthetics all make for faster-developing fires that are more challenging to fight.

    "All those products are wonderful, but not when they catch fire.

    "Our side-by-side burn demonstration is designed to showcase how residential sprinklers can improve public safety while offsetting the challenges of rural firefighting. It has a unique set of challenges due to the time it takes to muster firefighters, longer travel times over greater distances and because we must bring out our own water."

    TAMPA Hurricane season is over but residents of one luxury Tampa condo tower have been flooded out of their homes by a broken sprinkler system.

    Thousands of gallons of water cascaded down stairwells and poured through light fixtures of the Stovall on Bayshore Boulevard on Nov. 4 when a worker, about to fall off scaffolding, broke a sprinkler pipe that he had grabbed to steady himself.

    There was so much water in parts of the 22-story tower that it looked like Disney's Pirates of the Caribbean ride, as a Tampa Fire Rescue captain put it.

    Electricity remains shut off to all 33 units and residents have spent the past month in hotels, second homes or bunking with relatives.

    Despite damages estimated in the millions, "all in all, the building will be whole again before Christmas and hopefully within the next week,'' Gloria Giunta, president of the condominium association, said Thursday.

    Giunta said she was away from the Stovall that Tuesday morning when she looked down at her cellphone. "I was getting calls from everyone,'' she said. Giunta hurried home to find that firefighters already had responded to an automatic fire alarm in the building at 3203 Bayshore Blvd.

    Jason Penny, a spokesman for Tampa Fire Rescue, said water was dripping from the light fixtures as the fire crew entered the lobby. A security supervisor told them that a person doing drywall work had accidentally broken a sprinkler pipe while helping to renovate an 11th floor unit.

    The firefighters headed up and quickly turned off the sprinkler pump. But water already was inches deep in that apartment and flowing down the stairs and into 19 other units.

    "You can't turn off gravity,'' Penny said.

    Water was shut off to the entire building, and ServPro, a disaster response service, was soon "up and running with blowers and dehumidifiers and everything you could possibly think of to get the building stable,'' Giunta said.
