MAYBROOK Halmar International is contesting two citations for workplace safety violations and $14,000 in proposed penalties in the Dec. 2 collapse of a retaining wall that killed two workers and injured a third.
The federal Occupational Safety and Health Administration issued the citations and proposed penalties of $7,000 per violation following a nearly six-month investigation into the accident.
The accident happened on a 3-acre construction site Halmar owns at 918 Homestead Ave. in Maybrook, where a mockup for an aqueduct project for the New York City Department of Environmental Protection was being built.
One citation said a retaining wall collapsed during a concrete pour because three diagonal braces were absent. The other citation was for not having drawings of the wall present on the site.
Two employees of a subcontractor for Halmar, Precision Concrete Pumping of Albany, were killed as a result of the collapse. Timothy Lang, 53, of Saugerties, was pronounced dead at the scene. Scott S. Winkler, 50, of Monroe, was taken to a hospital but died eight days later.
Halmar principal Chris Larson said the company believes the plans were at the site, as well as the allegedly missing braces, so the workers had all the materials and information necessary to properly assemble the retaining wall.
OSHA spokesman Ted Fitzgerald said Halmar's notice of contest will be forwarded to the OSHA Review Commission, which will docket the case. Also, the case file will be forwarded to the Office of the Solicitor at the Labor Department, of which OSHA is a part.

MAYBROOK A wrongful-death lawsuit has been filed on behalf of the estate of one of the two men killed in the Dec. 2 collapse of a retaining wall at a construction site in the Village of Maybrook.
The suit was filed Friday in state Supreme Court in New York County (Manhattan) by Doreen Ellen Winkler, as the administratrix of the estate of her husband, Scott S. Winkler.
Winkler was killed Dec. 2 when a retaining wall collapsed while concrete was being poured for a mockup of a planned interconnection of New York City's Catskill and Delaware aqueducts in the Town of Gardiner. The mockup was intended to be used by workers to practice techniques on the actual construction site.
Winkler was taken to Westchester Medical Center in Valhalla and died eight days later. The Winklers, who lived in Monroe, had five children.
The suit names as defendants Halmar International, a general contractor on the aqueduct project, which owns the site where the accident happened at 918 Homestead Ave. in Maybrook, and several of its subsidiaries; the Haks Group and Haks Engineers, Architects and Land Surveyors, firms hired to do certain work on the project; and New York City and its Department of Environmental Protection.
The DEP operates and maintains the aqueduct systems that supply New York City and a number of area municipalities with water.
The suit asserts that all the defendants had "a duty to operate, control, supervise, manage and maintain the premises and all structures at 918 Homestead Avenue ... in a safe, lawful and proper fashion such that no person lawfully thereat would be caused to sustain personal injuries and/or death."

THE Cebu City Rivers Management Council (CCRMC) issued a cease-and-desist order against the construction of a retaining wall that Chong Hua Hospital is building.
CCRMC Chair Jose Daluz III said the construction had to be stopped because it encroached on the Guadalupe River.
The wall seems to be in the middle of the river.
Daluz said there was misinterpretation in the construction of the retaining wall.
Instead of having the wall repaired, another retaining wall was constructed as a reinforcement.
Atty. Dean Decal of Chong Hua Hospital said CCRMC asked them to stop the construction early this month and the hospital respected that.
The construction was halted since the order was received.
Daluz said he received word from the hospital that it will not continue the construction until the issue will be resolved.
The former councilor said an agreement between the Cebu City Government and Chong Hua Hospital has to be penned before construction can resume.
Decal said the Office of the Building Official already gave the hospital clearance for the construction but with a provision that a clarification be issued by the Department of Public Works and Highways (DPWH)-Central Visayas.
