New Mexico asking restaurants and to consider ban on smoking on patios - October 17, 2014 by Mr HomeBuilder

Updated: 10/16/2014 6:58 PM | Created: 10/16/2014 6:08 PM By: Eddie Garcia, KOB Eyewitness News 4

Its illegal for New Mexico restaurants to allow smoking indoors, but now, the state is urging them to ban smoking on their patios as well.

The New Mexico Health Department recently conducted a survey with almost 3,000 people asking them if they would support restaurants that choose to ban smoking on their patios.

The department reports that 75 percent of those surveyed said they would support the restaurants.

Representatives from the health department presented that information Thursday, calling on restaurants to consider banning smoking on their patios.

"It's something we would consider," said Kelly's Brew Pub owner, Dennis Bonfantine.

Bonfantine said he is seeing fewer and fewer smoking customers, and when they do light up, they won't smoke on his patio, even though it's currently allowed.

"Most smokers are very courteous. They usually go out on the sidewalk or the parking lot," said Bonfantine.

We spoke to people in Albuquerque's historic Old Town for their opinions on the matter.

"Nothing against smokers, but they can find other places to smoke where they're not harming others," said Emilie Sederholm.

Branson Aldermen to Vote on Smoking Ordinance Tonight - October 14, 2014 by Mr HomeBuilder

BRANSON, Mo. -- The Branson Board of Aldermen may vote on an ordinance that would ban indoor smoking at public places in the city.

The revisions include moving the distance smokers can be from doorways to 10 feet rather than 25 feet, while also lightening the smoking restrictions on outdoor areas like restaurant patios and golf courses.

Other revisions to the draft include the definition of a serving area, additions to the definition of public place, and additions to prohibitions of smoking in the city.

Those opposed say the city is overstepping it's boundaries - with the ordinance being considered despite a handful of businesses allowing smoking inside.

Others argue that enforcement of a ban would take away from more "pressing" issues in the city and that many tourists would no longer come to Branson if it was smoke-free.

Branson City Aldermen and proponent, Rick Davis, has voiced in the past that surveys have shown 87% of visitors support smoke-free environments in restaurants and hotels.

Davis has also said that restaurants in other cities, with similar ordinances to the one being considering in Branson, have seen an increase in business.

Public comment periods have already been held on the ordinance. The Board could vote tonight. The meeting is at 7 pm at Branson City Hall.

Yakima council offers peek at downtown plaza design - October 12, 2014 by Mr HomeBuilder

    Posted on October 7, 2014

YAKIMA, Wash. The conceptual design for Yakimas proposed downtown plaza unveiled Monday night features a small canal, sprinklers for kids to splash in, space for concerts and outdoor movies, shade trees, sitting areas, outdoor patios behind Yakima Avenue restaurants and a long, covered porch to shade outdoor markets.

The flexible design could host an ice rink in the winter, one big festival or lots of small events at once, said lead designer Kathryn Gustafson.

Gustafson, who was raised in Yakima and is now a world-renowned landscape architect whose designs include the Diana, Princess of Wales Memorial Fountain in London, told the crowd this design was inspired by the importance of irrigation to the community.

Reaction to Gustafsons presentation was largely positive among the 50 people gathered at The Seasons Performance Hall.

I think this is an incredible opportunity for our city and our future, said Bridget Russel, whose remarks were followed by a loud round of applause. A man who said that the design team did a good job listening to residents concerns and mitigating potential problems got a large round of applause as well.

Gustafson will present the final design plan to the Yakima City Council Tuesday evening. If it approves it, the next step would be to seek bids on a contract for the engineering work necessary to construct it.

But the plaza discussion could continue for up to a year before any construction gets underway. The City Council previously approved putting the final design to an advisory vote in the August 2015 primary elections, although some council members have hinted they want to renege on that plan.

Under the plan unveiled Monday, the plaza would be constructed on the parking lot across South Third Street from the Capitol Theatre. The location has been controversial, with some residents and business owners concerned about lost parking and traffic to nearby businesses.

But, the designers and the city say theyve found a solution. By switching parking on adjacent streets from parallel to angled spaces, more than 100 new parking spaces can be built to replace those lost. Within a one-block area, parking spaces would be reduced by just one from the current 417 spaces.
