Voters at the Monday, Nov. 26, Special Town Meeting will be asked to decide on five warrant articles pertaining primarily to the expenditure of Community Preservation Act (CPA) funds, mold remediation at the Town House, and a request to change the towns annual election date.
The special fall Town Meeting will begin at 7 p.m. in the Sippican School auditorium on Spring Street.
None of the warrant articles will ask for money per se, however three very specifically deal with the disbursement of funds.
Article 1 asks voters to appropriate $84,300 in Community Preservation Act funds to be used for open space, community housing and historic resources for fiscal year 2013. Passing Article 1 will allow the other two CPA-sponsored warrant articles to be funded, if voters approve.
Article 2 asks for specific amounts from specific accounts of the town Community Preservation Committee, which is the town body that decides which projects qualify and will be presented to Town Meeting for a vote. It seeks $10,000 from the CPCs open space account, $10,000 from the community housing account, and $10,000 from unrestricted estimated annual revenues for a total of $30,000 to be appropriated to the Buzzards Bay Area for Habitat for Humanity to build a home at 185 Wareham St.
Article 3 asks voters for permission to amend Article II, Section 1 of Marions General Bylaws, which pertains to the date of the annual town election, to strike the section entirely and replace it with this: The annual Town Meeting shall be held on the second Monday in May.
Marion Town Administrator Paul Dawson said the request to change the date of the annual town election was largely due to the fact that the election always abuts the Memorial Day holiday, causing a problem for people away from their voting precinct, as well as getting enough election workers because of the holiday.
By changing the date of annual Town Meeting to the second Monday in May we avoid the Memorial Day holiday, Dawson said.
If you like a cold beer in your hand while the waves lap at your ankles, your chances of doing that on a town beach in Marion will be absolute zero if Article 4 passes because Article 4 will make it illegal to bring your favorite alcoholic beverage to any of the town beaches. It asks to amend Article V, Section 4 of the town general bylaws by striking the section in its entirety and replace it with the following: It shall be unlawful for any person to consume alcoholic beverages on any beach owned by the Town of Marion without having first obtained a liquor license from the Board of Selectmen
The article came about after former Selectman Roger Blanchette broached the topic near the end of his last term at a regular selectmens meeting. Last winter, Blanchette noted that while one group was allowed to have a fundraiser involving alcohol at Silvershell Beach, another wasnt and he thought the rules should be the same for everyone.

After receiving the latest air quality tests, the Scranton School Board unanimously voted at a special meeting to keep students at William Prescott Elementary School, although it could mean longer days and a shorter school year for students.
The board made the announcement after tests revealed no indication of active mold growth or airborne microbial concerns.
Parents clapped as the board announced students would not be moved to the former Nativity Elementary.
Various tests performed on rooms in the elementary school Oct. 8 indicated safe mold counts, which school board members attribute to the spot remediation and intensive cleaning the rooms had undergone.
"I'm pleased with everything that's been done by maintenance and your staff," Joe Guzek of Guzek Associates said as he addressed board members and parents at a special meeting regarding the mold issue Monday night at the school.
Guzek Associates is the district's environmental engineering firm.
School board President Bob Lesh, along with directors Sean O'Shea, Kathleen McGuigan and Bill Fox were not in attendance.
The board estimates the project to completely remove the mold could take three months and is considering shortening the school year by three months so it can be completed over summer break.
Superintendent Bill King met with parents and administrators last week to discuss a tentative plan for shortening the school year to May 17 and adding approximately 45 minutes to each school day starting Nov. 5 to meet state and federal education hour requirements, he said.
The extended summer vacation would allow Guzek Associates to property repair the moldy areas of the building completely so the 2013-2014 school year wouldn't be interrupted. School is currently slated to end June 10, according to the school district's website.

MOUNT HOLLY The last five years have not been good at the municipal building on Washington Street.
The first floor experienced major flooding in 2007 and last August during Tropical Storm Irene. Irene's damages have cost the township about $600,000.
Now, mold has been discovered in ductwork on the second and third floors.
The Township Council on Monday declared a special emergency so the building can remain open as remediation is done. Budget money will need to be transferred to cover the costs.
About $16,000 has been paid since the mold was discovered Oct. 6, interim Township Manager Denise Rose said. That cost will increase because only the third floor has been remediated so far, Township Clerk Kathy Hoffman said. Work on the second floor is under way and is expected to take a few weeks to complete, she said.
The first floor will be inspected to make sure no mold is present, Hoffman said. Repairs to the first floor were completed in May.
Services in the building were moved around to minimize any future flood damage. The municipal court, previously on the second floor, is now on the ground floor. The first floor also has a lobby, restrooms, two holding cells, conference room, kitchenette and community room.
The Police Department, formerly at ground level, experienced significant damage in 2007 and last year. It's now on thesecond floor.
The mold was discovered during duct cleaning. Two local companies have been hired to do the remediation and replace ductwork, Hoffman said. Areas are being quarantined as the work is being done.
Air-quality levels did not require employees to be relocated, Rose said. Also, no asbestos remediation is required.

LOUISVILLE, Ky. (WHAS11) -- According to the Louisville.edu website, hundreds of University of Louisville students are being asked to move out of Miller Hall due to the presence of mold spores.
"To ensure the health and well-being of our students and staff, the university has decided to close Miller Hall for extensive cleaning, remediation and source identification. At this time, we do not know when the building will reopen and are preparing for the possibility that it may remain closed for the remainder of the fall 2012 semester," is the messaged posted on the website.
The mold spores, known as aspergillus and penicillium, are common types and do not pose a health risk. However, when levels become elevated they can cause problems for people with respiratory issues.
