Another case of brutal mistreatment points to a systemic failure to protect domestic workers

When Indonesian domestic worker Erwiana Sulistyaningsih departed from Hong Kong last Friday, she left a nightmare behind her. Eight months of alleged beatings by her employer had disfigured the 23-year-old so badly she was barely recognizable. A gaunt, pockmarked face with chipped teeth had replaced her once smooth, girlish features. Her feet, scalded with hot water, were black in color and had open sores.
Her case is another damning instance of the abuses faced by foreign domestic workers in Hong Kong. Foreign maids have been a ubiquitous feature of Hong Kong life since the 1970s, when the citys economy began to boom. Local women entered the labor force on a large scale and hired domestic workers from the Philippines, and subsequently Indonesia and Thailand, to keep households running.
After decades of toiling away in the anonymous confines of Hong Kongs high-rise homes, domestic helpers, now numbering around 300,000, are making their voices heard more effectively, campaigning for better working conditions, higher wages and entitlement to permanent residency.

True, legal protections are better in Hong Kong than in the Middle East and other East Asian countries that are large markets for foreign domestic workers, such as Saudi Arabia, the United Arab Emirates, Malaysia and Singapore. But helpers in Hong Kong are nonetheless vulnerable and often defenseless once disaster strikes. A 2012 Mission for Migrant Workers survey found that 18% of migrant domestic workers in the city had been physically abused. The Indonesian maid Kartika Puspitasari became a cause clbre last summer, when her two-year-long torture in the hands of a sadistic couple was made public. The revelation of Erwianas ordeal throws an uncomfortable spotlight on the treatment of domestic workers yet again.
Unable to walk when she arrived home, Erwiana needed the help of a fellow domestic worker she met at Hong Kong International Airport. Five days after arrival, she is still in hospital, but her uncle Shomat tells TIME she is doing better. We were shocked, and we feel pained seeing her in this condition, he says.

If she is lucky, Erwiana will get justice.Her family says they are determined to seek legal action against her former employer, and the Indonesian government has pledged to provide a lawyer for her. Other Indonesians, however, may never get redress. In a November report, Amnesty International singled out Indonesians as particularly vulnerable in Hong Kong. Unlike Filipinas, the other major group of domestic helpers in Hong Kong, Indonesians are required to find employment through recruitment agencies. These agencies are supposed to provide them with training, set up their contracts and arrange their visas. However, Amnesty found that the agencies failed to adequately represent the interests of women on their books.
The U.S. on Tuesday said in-person registration of domestic workers of foreign diplomats would be mandatory, an apparent fallout of the arrest of Indian diplomat Devyani Khobragade over alleged misrepresentation of the salary paid to her maid.
Without making any reference to the Khobragade case, which resulted in a stalemate in India-U.S. ties, the first-ever Federal Strategic Action Plan on Services for Victims of Human Trafficking in the U.S. contained a series of announcements on domestic workers and their alleged exploitation.
The action plan, released by the White House, stated that the in-person registration of domestic help of diplomats in Washington would be done soon after their arrival in the U.S.
The move came amid controversy over the arrest of Ms. Khobragade, the former Indian Deputy-Consul General in New York, on charges of visa fraud and misrepresentation of facts following complaints of exploitation lodged against her by her maid Sangeeta Richard. Both India and Ms. Khobragade have refuted the charges.
The action plan, released at a White House event by Cecilia Munoz, director of the Domestic Policy Council, stated: Department of State will develop procedures for the in-person registration of domestic workers employed by diplomatic personnel in the Washington DC area shortly after their arrival in the U.S. to apprise them further of their rights and available services.
However, it did not mention anything about in-person registration of foreign domestic workers in cities like New York, where a significantly large number of diplomats are posted.
Running into 80 pages, the document said the State Department will continue to address the protection of A-3 and G-5 workers through its regular internal working group meetings on domestic worker issues, which reviews allegations and cases, and discusses strategies and ongoing efforts to prevent abuse and ensure compliance with its requirements.
A-3 and G-5 visas are for foreign domestic workers who come to the U.S. with diplomats or foreign officials who work with international bodies like the UN, World Bank and International Monetary Fund.
The State Department will continue to streamline referrals of potential victims to its Bureau of Diplomatic Security, which coordinates with the Department of Justice and other agencies to investigate allegations of abuse.
According to the document, the State Department will continue to brief stakeholders annually, including NGOs, to raise awareness about efforts to protect and identify victims of trafficking.

India on Friday expelled a U.S. diplomat of the same rank as Devyani Khobragade.
The diplomat, Wayne May of the Bureau of Diplomatic Security in US Embassy, was given 48 hours to leave the country with government sources saying he was involved in facilitating the evacuation of the maids family from India with whom Ms. Khobragade had a contractual dispute.
The maids family left India for the U.S. two days before Ms. Khobragade was handcuffed and briefly detained in New York.
India is adopting the same course as the U.S., which asked her to leave after refusing a request to waive off her diplomatic immunity.
India is taking such an action against the U.S. after 33 years. It had sent back Political Counsellor George Griffin in retaliation for the returning of Prabhakar Menon.
Official sources preferred to say the U.S. embassy had been asked to withdraw its diplomat instead of using the term expelled.

Sheila said the decision to step up and help was an easy one: "We would prefer that the women use their energy to fight as they are going through treatment."

PUNE, India ?? The Indian government demanded Wednesday that the U.S. Embassy in New Dehli cease all commercial activities - including the running of its restaurant, bowling alley and swimming pool - in a spat over the arrest of an Indian diplomat in New York.
India has been apparently retaliating against America's diplomats in a campaign to pressure the U.S. attorney in New York to waive charges against Devyani Khobragade, an Indian diplomat who was strip searched by U.S. marshals when arrested in December.
Khobragade was apprehended on suspicion of not paying her maid the federal minimum wage and lying about it on her visa application. Khobragade, 39, pleaded not guilty to fraud charges and is free on bail while a federal prosecutor mulls whether to go ahead with the case.
The charges have caused an outcry among politicians especially in India, where the idea of an educated, middle-class woman facing a strip search is seen as outrageous. The U.S. Marshals Service said it was following standard procedure during the arrest.
Since the arrest, India downgraded privileges for U.S. diplomats in India. It limited immunity in case of serious offenses and decided that families of U.S. consular staff will no longer get diplomatic ID cards.
India on Wednesday ordered the American Community Support Association, which runs leisure offerings at the U.S. Embassy in New Delhi, to shut down its businesses, which include a bar, video club, sports field, beauty salon and gym.
In addition, all U.S. diplomatic vehicles will now be penalized for traffic-related offenses such as unauthorized parking and running red lights.
"Some retaliation has occurred," said Shashi Tharoor, India's minister of human resource development, in an article on the Prague-based website Project Syndicate.
"The initial American rationale (that foreign consuls in the U.S. enjoy a lower level of immunity than other diplomats) led India's government to re-examine privileges enjoyed by US consular officials that are unavailable to their Indian counterparts in the U.S.," he added.
The Indian government says providing commercial services to non-diplomats is a violation of the Vienna Convention on Diplomatic Relations, which states that "the premises of the mission must not be used in any manner incompatible with the functions of the mission".

A 10-year-old girl working as a maid was allegedly tortured to death by her employers in Pakistan's Punjab province for stealing Rs 100, police said today.
Police in the provincial capital of Lahore arrested a man named Altaf Mahmood, his wife Nasira and son Ibrar for allegedly killing the maid. A murder case was registered against them.
Superintendent of Police Omer Riaz told PTI that Mahmood, a resident of Lahore Cantonment, had employed Iram Ramzan of Okara district about three months ago.
Mahmood, his wife and son had confessed to torturing the young girl with plastic pipes, he said.
Iram, who was employed for a monthly salary of Rs 3,000, was the youngest of six siblings. Her father died some time ago.
Quoting the accused, Riaz said they had tied the girl and tortured her for two days. "When her condition deteriorated yesterday, they took her to Services Hospital, where doctors pronounced her dead," he said.
Mahmood told police that Iram had recently stolen Rs 100. He claimed she had stolen money several times in the past. "We wanted to teach her a lesson this time," he said.
The autopsy report said there were 23 marks of torture on the girl's body.
A court here today remanded the three arrested persons in police custody for three days.
