In an order passed by consumer forum against an interior decorator, who left work halfway and later claimed that there was no written agreement, observed that it is not a criminal case and should be adjudicated on the principle of 'preponderance of probabilities'.
The complaint filed by Shivaji Nagar resident Subhash Joshi said that he had hired an interior decorator Prashant Date for renovating his 30-year-old flat. Joshi said he needed to expand his house to accommodate his extending family and after calling for quotations from various interior decorators, he found Date's rates reasonable and hired him.
In his plaint, Joshi alleged that Date didn't finish the work for months where doors were not fit and kitchen trolleys were not installed to the extent that his family had to use the neighbour's washroom.After constant reminders for finishing the work, Date did not entertain Joshi and thus the latter lodged a complaint against him in the Pune District Consumer Disputes Redressal.
While Joshi claimed that he gave Rs3 lakh to Date, the latter contested it, stating that only Rs75,000 was given and that Joshi didn't did complete the payment because of which work was stalled.In his defence, Date denied the charges and said there was no written contract of agreement for the work and no specifications for standard of material and period of completion of work were mentioned. The forum observed that the case was not of criminal nature but civil and hence it should be adjudicated on the principle of 'ponderance of probabilities' which means assuming the evidence when there isn't any.
While the opponent claimed that Joshi's family obstructed his men from completing the work, the forum relied on the fact that Joshi employed another contractor to finish the job. "Hence a legitimate inference can be drawn that complainant was in a hurry to complete the work and must have co-operated," it said.
Joshi claimed that he had made a payment of Rs3 lakh and demanded a compensation of Rs1 lakh for the payment made to other contractor besides mental and physical trauma, the forum observed that there was no evidence of payment made for more than Rs75,000 and hence the forum partially allowed Date to pay Rs25,000 as lumpsum payment to Joshi.

The house at 1600 Commonwealth Boulevard in Kenthorst, Pennsylvania, would make Martha Stewart - or any interior decorator - cringe. But Don Draper would feel right at home.
The two bedroom, two bathroom house is a Mad Men time capsule, preserved almost perfectly since its initial construction and design in 1965 - right down to the tacky floral wallpaper in the kitchen and the sickening green bar with orange accents.
Today, thanks in part to the hit AMC show about a 1960s ad agency, vintage is back in style. And 'time capsule houses' like the one on Commonwealth Boulevard are in demand.

Two new entrepreneurs join the judging panel when Dragons' Den season 11 makes its New Zealand debut tonight on Sky's BBC Knowledge channel. James Croot caught up with one of them - interior designer Kelly Hoppen.
When and how did you first discover your skills as an interior decorator? And as an entrepreneur?
I have always wanted to be a designer. My mother always tells me that as a child I was constantly shifting furniture around our home, displaying everything at its best. I am sure it drove her crazy! Then when I was 16 and a half, a friend of my father asked me to design his kitchen. That was my first assignment and how my business started and I havent looked back since the passion to do what I do just grew stronger with time. I suppose I have always been determined and wanted to work hard.
What are the most important business lessons you learned in your youth?
Once when I was working with a life coach, one of the things he told me when I wanted to build the business was: 1) Your business never reaches the top, you can always take the next step. 2) If you step down from where you are standing, you can fall a lot further than you think. Also remember, success is not a day job, you have to work hard.
Who was your inspiration or mentor in business?
In terms of individuals who inspired me, there have been so many throughout my life and many for different reasons but a few that stand out include Donna Karan, Ralph Lauren and Nelson Mandela people who have a voice and are not frightened of speaking and are true to their thoughts are always an inspiration. My mother is also a great inspiration, she is a successful businesswoman, even to this day.
