QUEENSBURY The sections of fence have fallen in one by one over several months, another large piece hanging and ready to fall just feet from Whippoorwill Road any day.
Numerous young children gather near the fence every weekday to catch a school bus, some playing around it as they walk to and from the bus stop. Yet town officials have taken no action.
Residents of the neighborhood are concerned, and others in town are concerned about the condition of other fences.
Local businesswoman Denise Buher, owner of Orthopedic & Spine Physical Therapy at the corner of Bay and Blind Rock roads, has watched as a fence that separates her building from a neighboring apartment complex has fallen apart, with numerous slats broken and paint peeling.
Buher said her efforts to get the owner, Schermerhorn Real Estate Holdings, to repair the fence have failed. So she took her concerns to town officials, but was told they couldnt mandate repairs or even a new coat of paint.
Queensbury town code generally does not require owners of fences to maintain them in any way.
Craig Brown, the towns zoning administrator, said town code used to include requirements for fence maintenance, but that section of the law was taken out in about 2002. He said the difficulty in enforcing the code in a town with more than 13,000 parcels of property likely played a part in removing it.
It was probably an administrative nightmare to make sure people were painting their fences, Brown said.
The fence at the corner of Whippoorwill Road and Mountainview Lane has been in a state of disrepair for years, according to neighbors. One neighbor said she was not aware of any complaints to the town about it, but pointed out the home sits at the corner of a busy road and the collapsed fence is plainly visible.
Brown said he doesnt know whether a fence that poses safety concerns could be addressed under town law, but he pointed out any children playing on or around the fence would be trespassing.

The German Chancellor is not to blame for the eurozone austerity policies, the head of the European Commission has said - in an apparent attempt to mend fences with Berlin.
European Commission president Jose Manuel Barroso drew fire from Germany last month for saying that austerity had "reached its limits", in a public challenge to Europe's biggest economy.
Chancellor Angela Merkel's government has long championed fiscal restraint.
With Greece mired in recession, unemployment in some countries running at more than 25% and France being given more time to cut its budget deficit, there is growing pressure on Mrs Merkel and other hardliners to focus on growth and job creation, not austerity.
But Mr Barroso defended the policies of austerity and said growth built on debt was not sustainable, while reiterating his view that "pure austerity" measures were no longer acceptable.
"What is happening in France and Portugal is not Merkel's or Germany's fault," Mr Barroso told the Welt am Sonntag weekly paper.
"Growth that is based on debt is not sustainable. At the same time, the policies that people see as pure austerity have reached their limits of political and social acceptance.
"But the EU Commission says the current policy mix is right and we must continue it."
Mr Barroso also said Germany should not become complacent in its reform efforts just because its economy was performing better than others, adding that the country needed to open its markets for services and infrastructure.
He added: "Complacency would be dangerous for Germany. We should not forget how tightly interlinked the European economy is.

Home improvement projects can enhance a living space and provide a change of scenery, but a simple addition or renovation can quickly become not-so-simple.
Owners who arent careful could find themselves in financial or legal trouble, which is easily prevented by checking with a local building department before beginning.
Two of the most common mistakes include starting work without a permit and failing to check a contractors license, according to the Natrona County and Casper building departments.
A lot of times they start constructing things and they dont have a permit for it, Code Enforcement Supervisor Shelley LeClere said. And then its illegal.
Improvements that are cosmetic, such as paint or decoration, do not require permission, but LeClere said everything else does. Everything from kitchen or bathroom remodels to fireplaces and fences all require a permit.
People dont think about fences, but they do need a permit to put up a fence or to change a fence, she said.
Permits to change or install a fence are free.
For plans that involve outdoor additions, LeClere said owners also need to make sure the area zoning allows the project and ensure it does not cross property lines. Landowners of rental units also need permits for any renovation because of the public health and safety concerns that come with housing tenants.
Casper and Natrona County residents can apply for building, electrical, mechanical and plumbing permits at their respective building departments. Forms are also available online. Fees vary depending on project.
