A $20 million dispute over insurance coverage for damage caused by Superstorm Sandy at the Monmouth Park racetrack has been moved from state court to federal court at the request of the insurer, Lexington Insurance.
The filing, called a "notice of removal," was made last week based on the fact that Monmouth Park, its subsidiaries and the New Jersey Sports and Exposition Authority the plaintiffs in the case are all New Jersey-based, while Lexington is based in Boston.
The policy calls for a $1 million flood deductible and a $500,000 wind-and-hail deductible, and the parties disagree on the specific cause of the damage at the Oceanport horse track from the storm in October 2012. The track's barns, parking area, fences, signage, press box and other "major parts of the complex" suffered damage, according to the suit.
There also is a dispute about whether Sandy qualifies as a "named storm" according to the policy, and thereby is subject to the higher deductible.
Representatives of Monmouth Park say no. "It is clear that Sandy was not a hurricane but was declared a post-tropical storm prior to landfall in New Jersey," Dennis Drazin, an attorney whose firm runs the tacks, said in the suit.
Drazin also maintains that an executive order issued by Governor Christie prohibits insurance carriers from applying a hurricane deductible to Sandy-related damage.
According to Monmouth Park officials, delayed or unpaid claims at the racetrack have resulted in putting off numerous repairs as well as out-of-pocket expenses that have yet to be repaid including $400,000 incurred by the sports authority and postponement of work on revenue-generating new amenities like an amphitheater and boardwalk, now not scheduled to open until next summer.
Damage to the barns on the backstretch was so severe, according to the suit, that two contractors recommended they be demolished and replaced at a cost of $20 million. The partial payments have been insufficient so far to allow for such a replacement, according to the suit.
Reimbursement for $1.4 million also is sought for damage at the track grounds because of the site becoming an emergency staging area for thousands of first responders and other personnel in the months after Sandy. Additional, unspecified compensation for "punitive damages for willful and wanton violation of the executive order" also is sought.

HANCOCK COUNTY, MS (WLOX) -
Authorities from Harrison County to Slidell, Louisiana remain on the lookout for a man who escaped from the Hancock County Jail Sunday evening.
Sheriff Ricky Adam said the man on the run, 28-year-old Perry Thomas, is a known member of the Vice Lord Gang and is considered dangerous. Thomas was being held without bond for sexual battery of a child, theft and several other charges. He was arrested just one day before he escaped.
The question many people are asking is how were Thomas and another man able to escape?
Blood splatters, orange jump suits and sandals could be seen Monday hanging on and around the barbed wire fences where two inmates climbed out of the Hancock County jail courtyard.
Adam said the inmates were let outside at 5pm. Six minutes later camera show Montrell McPherson and Perry Thomas scaled three barbed wire fences and escaped.
"When they brought the inmates in, they noticed they were gone," Adam said. "They were two short, so they sent out a message to dispatch, dispatch notified everybody."
That notification went out just after 6pm. Then, 45 minutes later, Adam said McPherson was found in the woods across from the sheriff's department.
"He was caught because he missed his ride," Adam said. "The other inmate, as we have found out since, contacted a female to pick him up on the highway. Well, when he got in the car, he made her leave and left her behind."
Rhakee Lyons was the woman allegedly waiting for Thomas when he escaped. Lyons, along with Shondreka Lee, who authorities said drove Thomas to Slidell sometime after midnight, are in jail charged with aiding in the escape.

FLINT, MI -- Police are searching for the male driver responsible in knocking down two fences outside a West Bristol Road business.
Police were called for a hit and run around 10 a.m. Friday, June 27 in the 2000 block of West Bristol and spoke with security who informed them a hit and run took place three days earlier.
An officer checking surveillance video noticed a dark-colored pickup truck westbound on Bristol Road. The vehicle can be seen entering the property and striking a fence on the west side of the property.
The vehicle continued traveling across the property, according to a Flint police report, struck an east side fence and pushed it into a parked vehicle.
The driver is seen getting out of his vehicle and checking it for damage before driving off.
A rear driver side tail light was damaged on the parked vehicle, along with damage to the fence areas. No further suspect information was available at this time from police.

Cars, signs, fences and buildings were among property vandalized with white spray paint in Sterling, Illinois.
Overnight from Thursday, June 26 Friday, June 27, 2014 the Sterling Police say vandals used white spray paint to damage property between 4th Avenue East to 6th Avenue East and property on 4th Street North to East 7th Street.
Debbie Mills said she woke up to find her sons car had been vandalized with the white spray paint overnight.
You feel very invaded upon when youre property, which youre working hard to pay for, and someone just comes along and spray paints it, Mills said. Doesnt make you feel very good.
Police said cars, stop signs, fences, property belonging to Sauk Valley News, and the Maple Pancake House were vandalized.
