    The recently enacted Bethany Town Council ordinance regarding new driveway material requirements (permeable paving products) is flawed in its intent and legislative process.

    I put the word enacted into quotes because the council in its own words, tabled the ordinance and, somehow, finalized it at the same time. Tabling legislation as defined in Roberts Rules of Order and every other parliamentary procedure and law, is a means to suspend consideration of legislation for further consideration, not enact it. Apparently, thats not what happens in Bethany Beach, Del.

    Furthermore, the promulgation of the ordinance was woefully insufficient. As required by law, the public hearing for proposed law was printed in the newspaper of record and the hearing was open to the public. So unless you were at the hearing or happened to read the newspaper legal notices, you had no way of knowing the ordinance was enacted.

    Last fall, I began the long and tedious process of finding a contractor to replace a 40-year-old stone driveway with a concrete one. During those months, I dutifully consulted with the town building inspector, who was very helpful with my design. Finally, this last May, I finalized a deal with a concrete contractor who has done a lot of private work in Bethany Beach.

    Earlier this month, my contractor submitted a request for a building permit to the building inspector. To his and my surprise (and disbelief), the permit was denied. The new ordinance was in now in effect. The contractor, who has done many concrete projects for the town, had no idea that the driveway requirements had changed nor the availability and cost of permeable products.

    I immediately called the building inspector, who understood my concern but was powerless to provide any remedy. I then checked the Town website to research the ordinance. Incredibly, the newly enacted ordinance was not listed in the list of council hearing minutes or the list of recently enacted ordinances, so, I tried to call and email the mayor or any council member. None of them have phone numbers and, unbelievably, the email links did not work, not even to the town manager.

    Other than the building inspector, the only person to answer the phone was the towns office receptionist. She actually had to separately contact the assistant town manager to ask her to call me. And the assistant manager did call, offering her apology for what had happened to my permit, and tried to assure me that the ordinance was somehow properly enacted and promulgated. I strongly disagreed.

    After talking to the assistant town manager, I researched permeable paving products. Ironically, I learned that both permeable concrete and pavers will eventually clog up, and require regular maintenance to remain permeable. And, not surprising, both are a lot more expensive.

    Faced with this new ordinance, I suspect that most people will now stay with cheaper stone driveways, even though the use of herbicides will increase enormously. Just another unintended consequence of ill-conceived legislation. Too bad.

    Larchmont Road Paving Work Will Add Some Excitement To The Workweek – Patch - July 26, 2022 by Mr HomeBuilder

    LARCHMONT, NY The price of the benefits of fresh asphalt and a smooth tarmac on Larchmont streets will be a little extra planning on commuters' and homeowners' parts for a few days.

    The Village of Larchmont announced that road paving will be taking place from Monday, July 25 - Friday July 29.

    The affected roads will be:

    Residents of these streets will not have access to their driveways between the hours of 8 a.m. - 5 p.m., from Monday, July 25 to Friday, July 29. Affected residents are encouraged to find alternative locations for storage of vehicles during road work hours if they need use of their cars.

    Residents of Ervilla Drive will be affected by similar closure conditions due to paving on Monroe.

    Larchmont Public Works will distribute notices to all affected residents in the next few days.

    The Larchmont Police Department will assist with traffic control.

    Sentara Obici Hospitals parking lots and access roads are in the midst of a $1 million repaving this summer.

    Its the first time since the hospital opened in 2000 that they have been repaved. Blair Brothers Paving of Suffolk is doing the work, which involves milling two inches off the old surface and laying down more than 7,800 tons of new and recycled asphalt on 71,000-square-yards of parking lots, according to Sentara Healthcare spokesman Dale Gauding.

    There will also be fresh, new striping to clearly mark parking spaces, crosswalks and wayfinding aids for safety. Some of the decorative pavers that have shifted out of place over the years due to repeated freezing and thawing, and that have created a trip hazard, will be removed.

    Temporary signs are in place to direct patients and visitors to areas open for parking during the project.

    Graves: Expect Infrastructure Costs & Inflation to Get Worse – For Construction Pros - July 26, 2022 by Mr HomeBuilder

    According to the Associated General Contractors of America (AGC) analysis of the most recent U.S. Bureau of Labor Statistics data,nonresidential construction input prices for materials and services increased 1.1% between May 2022 and June 2022. In total, prices have increased 16.8% since June 2021.

    Changes in material prices include:

    Contractor bids, the AGC said, are not able to keep pace with increases. And it appears that material prices will continue their upward march.

    During a July 14 Roundtable entitled Inflation Crisis Impacts on Infrastructure" held bythe Republicans on the Transportation and Infrastructure Committee, the witnesses who testified agreed with this sentiment.

    Representative Sam Graves (R-MO), who chaired the Roundtable said: its possible and even likely that the bad economic news is going to get worse, and that (t)he Biden administration has left inflation completely unchecked.

    While State DOTs are accustomed to doing more work with less money, the stress they are feeling due to price increases and the supply chain are forcing companies to lose business. What's more, the dollars from the Infrastructure Investment and Jobs Act (IIJA) are not even coming close to making an impact due to inflation.

    Inflation is hitting the pocketbook of every American, and its hitting the transportation and construction industries particularly hard, Graves said. As a result, inflation is eroding the value of the infrastructure laws funding and causing states to delay or cancel projects."

    The challenges contractors face as inflation remains at historic levels, as infrastructure dollars decline in value and as projects become more and more difficult to carry out, are far reaching.

    George Palko, president of Great Lakes Construction Company and current AGC Highway Transportation Division Chairman, told the panel that in recent months inflation-related cost overruns led to his firm having three bids rejected by Ohio DOT.

    "Being a contractor, we are experiencing construction inflation and the impacts of not getting jobs awarded," Palko said. "We are seeing vendors and subcontractors walking away because of what costs really are by the time a job gets awarded."

    One of the jobs Great Lakes bid on was a project in Cincinnati that they estimated would cost $270 million. The Ohio DOT had estimated it at $180 million, making it clear that project estimates are not keeping up with inflation.

    "Those estimated numbers constitute the states budgets for the year for their transportation programs," Palko said. "If we are going to continue to exceed budgets and estimates by 15, 20 even 50 percent, how are we going to show the public that we are putting additional work into place? That's a major concern of ours."

    With prices rising, contractors are facing extreme challenges in bidding out work for the longterm projects the IIJA calls for and the problem is twofold. Projects that are happening right now are experiencing financial hardships due to the supply chain and projects that have three to four year timelines are being bid with prices as they stand today - making them much more expensive.

    "Prior contracts, in terms of contractors, are not being impacted by construction inflation if they were sold prior to six months ago," Palko said. "It's the supply chain that is dictating more of a problem on prior contracts. For projects that have been sold within the last six months through today, the problem is definitely construction inflation. With vendors and subcontractors changing terms from quoting us a firm price at the time of delivery, to quoting us a price at the time of bidding to time of actual delivery. So if we aren't going to put in a steel pipe in place until two years from now, we are guessing what the price will be and building it into our price that we submit to the DOT."

    And the demand to lock prices and contracts in place is extreme.

    "There is a pressure to commit to a job sooner rather than later especially as there is a 40-50% price increase on the top items we use on these projects," Dr. Shawn Wilson,secretary of the LouisianaDepartment of Transportation said. "If there is a multi-year project, you will see instability in pricing and in material availability. The answer isn't necessarily to pay more, but maybe to extend the time or to allow alternative materials to get through this."

    Right now, suppliers are also only guaranteeing prices for shorter windows of time.

    "We need to get projects moving faster because of this," Wilson says. "We need to give reassurance and give advancenotification for contractors to be able to proceed with these commitments."

    Witnesses of the Roundtable included representatives from the National Stone Sand and Gravel Association, American Trucking Associations, Associated General Contractors of America, National Association of Manufacturers, American Association of State Highway and Transportation Officials, Virginia Department of Emergency Management and City of Wilmington, NC.

    The Roundtable witnesses and the AGC have called on public officials to take measures to curb rising prices, particularly since they are impacting the affordability of public infrastructure projects. Government agencies, the AGC said, should address supply chain issues, and the Biden administration should remove construction material tariffs that are contributing to rising prices."

    "The more materials prices increase, the harder it will be for public officials to build new schools, roads and other infrastructure," said Stephen Sandherr, the AGC's CEO. "Taking steps to address rising materials prices will help construction employers and taxpayers alike."

    I-65 in Robertson Co. Narrowed to One Lane in Both Directions for Emergency Paving – tn.gov - January 25, 2022 by Mr HomeBuilder

    ROBERTSON CO., Tenn. The Tennessee Department of Transportation is conducting a single-lane closure in the northbound and southbound lanes of Interstate 65 for emergency milling and paving.

    The interstate was narrowed to one lane Sunday from mile marker 111 to mile marker 118 in each direction. The closures will remain in place through the morning rush hour until the work is complete in the coming days.

    Recent back-to-back winter storms and high traffic volumes have caused large potholes to form within the 9-mile widening project on I-65. The asphalt pavement continues to deteriorate creating unsafe driving conditions and causing property damage.

    The closure will shorten as the road is repaired. Crews are currently working in the northbound lane, which is expected to reopen first. Work will then move to the southbound lane.Motorists are advised to plan for extra travel time, and slow down while in a work zone.

    Etowah Mega Sports Authority waiting for work to resume; play date still up in the air – Gadsden Times - January 25, 2022 by Mr HomeBuilder

    The Etowah County Mega Sports Complex Authority moved a step closer to getting back to work on the soccer complex located in Rainbow City with the awarding of a bid for paving work at the site.

    The authority on Friday awarded a bid for paving work after pulling that task out of its project bid to handle separately. Chairman Ralph Burke said as originally bid, the parking area at the complex would have been crush and run gravel.

    Authority members did not want a gravel parking lot, and decided to bid that project separately. Burke said the low bid was $312,000 for asphalt, with some grading work included, and $10,000 for striping the parking lot. He said contractor Milam & Company had a bid of $355,000 for the work, so this bid will means savings for the authority.

    After a complicated fall, the authority completed a bond issue delayed by legal action Treasurer Hugh Miller said, and has paid money owed to contractors and other money borrowed.

    To date, the authority has paid Milam & Company $4,953,189 for work completed,$926,868 to Chambless King Architects and $91,641 to other engineers.

    As to the larger question of when the soccer field will be ready for play, Burke said they can't project that just now. Getting sod down is a key, he said, and allowing time for it to set up a good root system.

    GameDay, the company that will install the sod, is working on a project now at Westbrook, he said, and says the Etowah County complex is their next job. He said there is some "tidying up" to be done, and fixtures in storage to be brought to the complex's concession stand building.

    There is paving work to be completed, Burke said, and contractors have been told if there are any plants or trees with "life in their roots," to plant them. Some are in place, he said; he was not sure about whether they would survive.

    Burke said the authority is looking at whether to hire a complex director who would handle hiring and management of the facility, or a management company to run it.

    A committee is looking at what other facilities have done and may consult with representatives about their experiences. Burke said Oxford's sports complex has its own employees; the Sand Mountain Park and Amphitheater has a management company.

    Some members of the authority questioned how much of the authority's legal fees were the result of legal actions brought by Sen. Andrew Jones, R-Centre, and joined by Etowah County Tourismthat held up the bond issue and the resumption of work on the complex.

    Miller said he didn't have those expenses tabulated separate from other legal costs.

    He said the legal action had cost "four months playing time" when the complex would have generated revenue.

    Rep. Gil Isbell, R-Gadsden, attended the meeting, along with authority members Randy Vice, RogerBoatner, Craig Ford, Trina Willett, Burke and Miller.

    Isbell said he appreciated the work done to resolve the legal issues.

    Cherokee CountyJacksonville maintenance crews are scheduled to begin edging on FM 2750 between FM 2064 and SH 110. Expect daytime lane closures with traffic controlled by flaggers. Rusk Maintenance crews will be working on base repair and edges on FM 851. Expect daytime lane closures.

    Cherokee County construction projects updates:

    FM 22 Safety Widening and Bridge Replacement Project

    The contractor is scheduled to continue widening the roadway and begin construction on the bridge at Little Turnpike Creek. Flaggers will be present during construction hours. Expect daily lane closures when work is being done. The bridge will be closed during construction. The project will widen the existing roadway, replace three bridges and incorporate safety upgrades.

    US 84 Widening

    The contractor is scheduled to continue widening cross structures, driveway upgrades and begin base repairs/widening. Lane closures will be in place. Expect delays on this corridor when construction is in progress. The project will widen and resurface the roadway, along with adding safety upgrades.

    FM 235 Safety Widening

    No work is scheduled this week. No lane closures will be in place. The project widens the existing roadway and incorporates safety upgrades.

    County Road Bridge Replacement Project

    No work is scheduled on CR 3203 and CR 1504. Both roadways are open to traffic. Construction of the new bridges is ongoing on CR 2905 and CR 2614. Both roads are closed to through traffic. The project is replacing the existing bridges at each location with new structures.

    SH 204 Super-2 Widening Project

    The contractor is scheduled to continue placing mowstrip and final surface striping. Lane closures will be in place during construction. The project adds passing lanes and incorporates safety upgrades.

    US 69 Sidewalks in Jacksonville

    No work is scheduled. The project is constructing sidewalks along US 69 in Jacksonville.

    US 79 Rehabilitation Project

    The contractor is awaiting final punch list. Lane closures will be in place, expect delays on this corridor when construction is in progress. The work zone speed limit is 60 mph. The project will rebuild the roadway pavement and upgrade bridge rails.

    SH 21 Resurfacing Project

    The contractor is scheduled to begin road work construction on driveway upgrades and structure extensions. Lane closures will be in place. The project will consist of pavement resurfacing.

    Gregg CountyMaintenance crews will continue bridge channel maintenance on SH 135, just north of SH 31. There will be possible right-lane closures north or southbound over Rabbit Creek and Rabbit Creek Relief bridges. Flaggers will be present if needed. Crews also plan to continue with mobile operations, patching potholes and removing debris from various roadways. Mobile operations will have contract TMAs present for protection.

    Gregg County construction projects updates:

    This project is part of the City of Longview Guthrie Creek Trail project. It will consist of building a bridge over Guthrie Creek to allow bicyclist and pedestrians to travel under Spur 63. The traffic will be reduced to two lanes, one northbound lane and one south bound lane to allow the contractor to build half of the bridge. Traffic will be switched later to allow completion of the bridge construction. Expect delays.

    FM 2204, etc., Safety Improvement Project

    Contractor is scheduled to complete punch list items this week. This project consists of culverts, safety end treatments, drainage upgrades, new MBGF and driveway asphalt. There will be daytime lane closures. Expect delays.

    FM 2206/Harrison Road

    This project consists of widening a two-lane road to four lanes with a center turn lane. This includes drainage structures, flexible base, curb and gutter, sidewalks, hot mix and pavement markings. Contractor will be extending culverts and constructing detours. There will be daytime lane closures. Expect delays.

    Henderson County construction projects updates:

    SH 198 Bridge Project

    The contractor is scheduled to work on the new northbound bridge and roadway elements. Motorists should be prepared for lane closures and delays. The speed limit has been reduced to 50 mph throughout the project. The project consists of the construction of replacing bridges, approaches, grading, structures, asphalt concrete pavement (ACP) base, ACP surface, retaining walls, curb & gutter, MBGF, and pavement markings.

    SH 334 Bridge Project

    The contractor is scheduled to continue final cleanup work. Expect lane closures and delays. The project will upgrade the roadway from two to four lanes. The contract consists of the construction of bridges, storm sewer, guardrail, base, pavement surfaces, and pavement markings.

    Rusk CountyMaintenance crews are scheduled to begin edge repairs on FM 839 near Lake Striker. Flaggers will control traffic with one-way traffic setups in all locations. Expect daytime lane closures.

    Smith CountyTyler Maintenance will be performing ditch work on FM 2493 (Old Jacksonville Hwy) near Loop 323. Expect daily lane closures with flaggers controlling traffic. A second crew will be on SH 155 south, just before the first bridge at Lake Palestine. This crew will also be performing ditch work off the road in the right-of-way. Once this job is complete, this crew will move to FM 346 in Flint to extend a culvert under the roadway just before FM 2868. This will be under lane closures with flaggers controlling traffic. This area is expected to see heavy congestion. Please seek an alternate route.

    Smith County construction projects updates:

    US 271 Rehab, Turn Lanes, and Pavement Overlay

    Crews will be installing driveway culverts on the northbound and southbound sides. Traffic control will be managed by flaggers as needed. The project consists of paving, structures, MBGF, and pavement markings from I-20 north to the Gregg County line. The portion from I-20 to FM 16 also includes turn lanes and pavement rehabilitation.

    FM 2493 Widening Project

    The contractor is scheduled for miscellaneous project clean up. Temporary lane closures are anticipated from 9 am to 4 pm. The project will widen FM 2493 from two lanes to a four-lane divided roadway with a flush median.

    US 69 Overpass at FM 346

    Contractor is scheduled to complete punch list items and project cleanup. Temporary lane closures will be in place for restriping and asphalt repair. The work zone speed limit is 60 mph on US 69. The project consists of building a new US 69 bridge over FM 346.

    SH 155 Resurfacing Project

    The contractor is scheduled to continue the mill and inlay between Frankston and Coffee City. Expect lane closures when work is in progress. When in progress, hours will be from 8 p.m. to 5 a.m., Sunday through Thursday nights. Expect delays. The project will resurface the roadway, upgrade drainage structures, and repair bridge joints.

    Sidewalks at various locations in Smith County

    The contractor is scheduled to continue work on SH 110 in Troup. Daily lane closures are expected. The project is adding sidewalks along SH 64W in Tyler, SH 110W, and SH 135N in Troup.

    SH 135 Widening Project

    No work is scheduled. The work zone speed limit is 45 mph. The project is adding passing lanes, improving drainage structures, and pavement resurfacing.

    US 69 (Glenwood Blvd.) Resurfacing Project in Tyler

    No work is scheduled. When in progress, work will be conducted from 8 p.m. to 5 a.m., Sunday through Thursday nights. The project consists of pavement resurfacing.

    FM 344, etc., Safety Improvements

    No work is scheduled. The project consists of improving drainage, culvert work, and guardrail upgrades.

    US 69 (Broadway Ave.) Resurfacing Project

    No work is scheduled. When in progress, work is slated from 8 p.m. to 6 a.m., Monday through Thursday, and on Sunday from 9 p.m. to 6 a.m. The project consists of bridge rail and pavement resurfacing.

    I-20 Resurfacing Project

    No work is scheduled. When work is in progress, the schedule is from 8 p.m. to 6 a.m., Sunday through Thursday. The work zone speed limit is 65 mph. The project consists of ramp improvements and frontage road construction.

    SH 64 Bridge Maintenance

    The contractor is scheduled to continue working on bridge repairs. When work is in progress, hours will be 9 a.m. to 4 p.m. Lane closures will be in place when working on the metal beam guard fence and retrofit rail. The project consists of bridge maintenance and repair.

    Tyler State Park Bridge and Resurfacing Project

    No work is scheduled for this project. The project will consist of bridge and pavement resurfacing.

    I-20 Upgrades at Barber Road

    This project consists of widening on ramps and exit ramps, culverts, drainage upgrades, new MBGF and bridge rails on the Barber Road overpass, and asphalt overlay. No work planned this week.

    SH 110 & FM 346 Landscape Project

    The contractor is scheduled to continue forming various landscape development. The project consists of landscape development.

    Sign Replacement at Various Locations in Smith County

    No work is scheduled this week. The project will consist of replacing small roadside signs.

    Van Zandt CountyCanton Maintenance will be conducting base work on FM 316. Daytime lane closures will be in place with flaggers controlling traffic. Bridge crews will also be working in various locations in the county. No delays are expected.

    Van Zandt County construction projects updates:

    I-20 MBGF Improvements (Van Zandt, Smith, and Gregg counties)

    Crews will be performing bridge rail work (eastbound side), concrete work, cleaning, and grading along the eastbound and westbound shoulders Gregg County (eastbound side), and cleaning and grading in Smith county (eastbound and westbound). Lane closures will be in effect nightly and will be managed by message boards and channelizing devices. This project is to construct safety improvements consisting of upgrading MBGF and mow strip.

    SH 19 Super Two Widening & Overlay

    Crews will be performing roadway widening operations on the southbound side and extending drainage structures on the northbound side. Traffic control will consist of a southbound shoulder closure and will be managed by flaggers as needed. The project consists of Super 2 work including grading, base repair, treated subgrade, flex base, OCST, PFC surface, structures, signs and pavement markings.

    CR 2918, etc. Bridge Replacements

    Crews will be installing concrete mowstrip on CR 2318 and CR 2918. Both roads remain closed on each side of the bridges until project completion. The project consists of removing and replacing four bridges.

    Safety Improvement Project

    The contractor is scheduled to continue driveways and drainage structures work on FM 346 in Smith County. Motorists should be prepared for lane closures and delays. The project includes grading, structure work, guard rail replacement, and bridge rail upgrades.

    Wood CountyMaintenance crews will be performing bridge maintenance on US 69 at the Sabine River bridge. Expect one lane closure with flaggers and a pilot car. No delays are expected. Another crew will be on FM 14 between SH 154 and the Hawkins city limit performing base failure repairs. Expect one lane closure and a pilot vehicle and flaggers controlling traffic.

    Wood County construction projects updates:

    SH 154 Turn Lane Project

    The project is substantially complete and in the punch-list phase. Shoulder closures could occur occasionally with minimal delay to motorists. The project includes pavement widening, hot mix asphalt concrete overlay, signs, and pavement markings.
