    Babri Demolition: SC Prepones Hearing to October - September 3, 2013 by Mr HomeBuilder

    The Supreme Court today preponed by about two months the date of hearing in Babri Masjid demolition case against L K Advani and 19 others after CBI pleaded for an early hearing which was not opposed by the senior BJP leader.

    A bench headed by Justice G S Singhvi, before whom the matter was mentioned by the CBI, passed the order and preponed the case to first week of October which was earlier listed for hearing in December.

    The case was filed by CBI challenging Allahabad High Court's verdict on dropping conspiracy charge against Advani and 19 others in Babri Masjid demolition case.

    Pleading for early hearing, senior advocate P P Rao, appearing for CBI, submitted that the case was earlier directed to be listed in September for hearing but registry record says that the matter will be taken up by the apex court in December.

    Senior advocate K K Venugopal, appearing for Advani, also agreed to preponement of the hearing date.

    The apex court had earlier pulled up CBI for the delay in filing an appeal against the Allahabad High Court verdict.

    CBI had filed an appeal in the apex court challenging the verdicts of a special CBI court and the Allahabad High Court dropping conspiracy charge against Advani, Kalyan Singh, Uma Bharti, Vinay Katiyar and Murli Manohar Joshi.

    The others against whom the charge was dropped included Satish Pradhan, C R Bansal, Ashok Singhal, Giriraj Kishore, Sadhvi Ritambhara, V H Dalmia, Mahant Avaidhynath, R V Vedanti, Param Hans Ram Chandra Das, Jagdish Muni Maharaj, B L Sharma, Nritya Gopal Das, Dharam Das, Satish Nagar and Moreshwar Save.

    Bal Thackeray's name was removed from the list of accused persons after his death.

    CBI has challenged in the Supreme Court the May 21, 2010 order of the high court, which had upheld a special court's decision to drop the charge against the leaders.

    THE demolition of three Capitol buildings on the properties leased by Ayala Land Inc. (ALI) will be done by the administration, Negros Occidental government administrator Enrique Pinongan said.

    There will be no more bidding to be conducted for the demolition of the buildings previously occupied by the Office of the Provincial Agriculturist (OPA), National Telecommunications Commission and the Provincial Environment Management Office (PEMO), he said.

    Pinongan said the demolition will be done by direct administration or by manpower from the General Services Office and the Provincial Engineers Office.

    "Materials recovered from the demolition will be issued a waste material report and an inventory and inspection report as it already has gone through the Commission on Audit," he said.

    The PEMO and OPA buildings have been declared earlier as a fire hazard and fit for demolition, he further said.

    Pinongan said they may also auction off the demolished materials such as wood, and roofing and steel bars.

    Proceeds from the earlier demolition of the old Provincial Jail Building generated about P800,000 for the General Fund of the province, he also said.

    However, there is still no schedule yet when the demolition will start, said Pinongan, but that, it will be within September.

    Earlier, assistant provincial legal officer Mary Ann Manayon-Lamis said the Capitol had entered into two contracts - lease and sale - with ALI.

    She said theres no Temporary Restraining Order or injunction on the lease contract that could impede its implementation, adding that Ayala can go ahead with the contract if they think theres no problem with it.

    Federal Territory Minister Tengku Adnan Tengku Mansor should be blamed for the demolition of part of a temple in Kuala Lumpur by DBKL officers, said MIC Youth.

    PETALING JAYA: MIC Youth said today Federal Territory Minister Tengku Adnan Tengku Mansor should take responsibility for demolishing part of the 101-year-old temple in Jalan P Ramlee, Kuala Lumpur, yesterday.

    Its chairman, T Mohan, told FMT that Tengku Adnan had failed to stop Kuala Lumpur City Hall (DBKL) enforcement officers from demolishing the wall of the Sri Muneswarar Kaliyaman temple despite a cabinet decision not to do so until a solution was found.

    Earlier, Prime Minister Najib Tun Razak has ordered the Federal Territories Ministry and DBKL officers not to demolish the temple.

    It seems like Tengku Adan and DBKL officers are trying to challenge the prime minister, said Mohan.

    He said Tengku Adnan had promised to allocate funds to beautify the temple before.

    But yesterday, Tengku Adnan broke his promise by demolishing part of the temple, he added.

    Mohan was one of the eight people arrested by police after they tried to stop the demolition.

    The others are temple caretaker R Nalini, PKR leader P Jayathas, MIC Youth secretary C Sivarraajh, MIC Federal Territory Youth chief D Tharmakumaran and temple photographer known only as Prem.

    Mohan said the temple had been issued an eviction notice on June 13 ordering it to vacate the premises before June 26.
