    Demolition of illegal market stalls set - December 28, 2013 by Mr HomeBuilder

    THE Bacolod City Government has scheduled the demolition of illegal market stalls at the downtown area and the three main public markets in the city on January 2.

    Senior Superintendent Edgardo Ordaniel, acting director of Bacolod City Police Office, said Friday that this was agreed during the meeting with Mayor Monico Puentevella and the members of the Task Force Maninlo Kita para sa Kaayohan that sought to address the problem of illegal vendors.

    Ordaniel said that before the demolition will proceed, they will conduct a dialogue with the affected vendors at the downtown area and at the Central Market, Burgos North Market and Libertad South Market.

    He said the vendors will be given 10 days to vacate the area, and if they failed to do so, the police will enforce the order of the city mayor.

    Ordaniel said the program aims to clean the downtown area and the public markets of obstructions.

    The illegal vendors also cause traffic congestion and are bad for the image of Bacolod City, he added. (MAP)

    Officials resume demolition of second and third floors of fire-ravaged building - December 27, 2013 by Mr HomeBuilder

    Following the disposal of writ petitions by the Madras High Court, officials from the Local Planning Authority (LPA) with assistance from Corporation and Police on Thursday resumed the drive to demolish the second and third floors of Vigneshwar Cresta building on Avanashi Road. A fire that broke out in the building on April 25 this year claimed four lives and left many injured.

    Officials from LPA had served a notice on the building owner in April 2013 for violations and commenced a drive to demolish the structure. However, the demolition drive was suspended in two-days following stay by the Madras High Court based on a writ petition by the building owner.

    The Madras High Court on November 19, 2013 had disposed off the writ petitions stating that it would not interfere with regard to the second and third floors which were not in consonance with the approved building plan. However, it directed the respondents i.e., the Member Secretary of LPA to consider a fresh appeal, if any filed by the building owner in respect of ground and first floor, by merit and in accordance with the law.

    Consequently, the building owner had filed an appeal before the Member Secretary on December 10 seeking regularization of the building, sources said.

    While the prayers of the petitioner regarding the ground and first floor are under consideration, District Collector Archana Patnaik, who is also the Chairperson of the LPA on December 24, 2013 ordered for demolition of the second and third floors. Demolition order was sent to the building owner by post and was also pasted on the doors at the building and as well as at the residence.

    Decision to demolish came in the wake of the Fire and Rescue Services Department denying No Objection Certificate for failure to comply with ten conditions, Public Works Department in its stability certificate declaring that the structure was not fit for occupation. Coimbatore Corporation has also turned down the application from the petitioner seeking regularization of the building under the provisions of the Government Order No 234 and 235. The orders were meant only for regularization of buildings constructed before July 1, 2007 (subject to extent of violations and deviations).

    Meanwhile, the LPA in its reply stated that approved building plan of December 22, 1999 was for industrial use but the same has now been turned into a commercial building. The height and width of the basement, extent of area constructed on ground and first floor were more than the approved plan, the notice added.

    Officials said that the notice issued in April following the fire accident continues to be in force. Accordingly, the demolition drive began on Thursday morning amid tight police security under the supervision of Member Secretary of LPA S. Chandrasekharan. Demolition is expected to be completed in a day or two.

    UN Agency Condemns Israeli Demolition of Arab Homes, Urges Adherence to International Law

    New York, Dec 26 2013 - The United Nations agency assisting Palestinian refugees today condemned Israels latest demolitions in the West Bank which have displaced 68 people, including 32 children, in the depths of winter, saying it is violating international law and calling on it to abide by its obligations.

    Because of these demolitions, which violate international law, these historically self-sufficient communities have been forced to endure the pitiless seasonal weather in inadequate housing, entirely dependent on international assistance, the UN Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) said of the demolitions which took place on Christmas Eve in Ein Ayoub near Ramallah and Fasayil Al Wusta near Jericho in the Jordan valley.

    We call on Israel to abide by its obligations under international law, most particularly to ensure the humane treatment and protection of the civilian Palestinian population at all times, including through an immediate halt to administrative demolitions, it added, noting that to date at least 1,103 Palestinians have been displaced throughout the West Bank in Area C, and East Jerusalem, exceeding the numbers for 2012.

    Area C, where Israel still retains control over security, planning and building, represents over 60 per cent of the West Bank.

    The majority of those displaced most recently, 46, are Palestinian refugees, including a five-year-old girl who is paralyzed from the waist down. They are now being sheltered in tents distributed by the Palestinian Red Crescent, with night-time temperatures plunging to around zero Celsius, while some 750 head of sheep and goats are without shelter at this crucial lambing season.

    These are Bedouin communities who managed to weather the recent snow storms, UNRWA said. On this day, many people around the world are celebrating family life with their children. But thanks to the administrative demolitions these families have lost their homes and their livelihoods are severely threatened.

    The Agency stressed that administrative demolition is not a solution for Palestinians in Area C and are a common trigger of forced displacement, possibly amounting to a forcible transfer and forced eviction under international humanitarian law and human rights law.

    It reiterated a statement in September by UN High Commissioner for Human Rights Navi Pillay that mass demolitions raise serious concerns about the prohibition on forced eviction under international human rights law, and Israels obligations to respect, protect and fulfill the rights of Palestinians to adequate housing and freedom from arbitrary or unlawful interference with privacy, family and home.

    Of the 1,103 Palestinians displaced so far this year, about a third are refugees, and at least 558 are children, including 195 refugees.

    MERIDEN Demolition of the abandoned power plant atop Cathole Mountain will begin next month under an agreement between the city and the plants owner.

    The city and NRG finalized a settlement over the abandoned power plant building on South Mountain Road earlier this month. It calls for NRG to begin demolition by Jan. 31 and complete the work by June 30. Since first proposed about 15 years ago, city officials and residents have been concerned about the visual impact of the 82-foot-tall structure.

    In addition to the demolition, the city will receive $500,000 in two installments before June 30. Beginning in the 2014-15 fiscal year, the city will receive an annual tax payment of $71,886.96 from NRG after the fair market value of the property was set at $2.93 million. Meriden will keep $701,800 in performance bonds since work on the plant and surrounding property was not finished.

    City Manager Lawrence J. Kendzior said he is glad demolition will begin early next year.

    We were pleased with the outcome of the (Connecticut Siting Council) hearings (and) relieved to bring this dispute with NRG to a satisfactory conclusion, Kendzior said.

    NRG, doing business as Meriden Gas Turbines, owns the abandoned plant, which includes two buildings, a fuel tank and water tank on more than 36 acres. A 544-megawatt, natural gas-fired generating plant was planned, but financial problems and declining need for power generation halted the work.
