    Vikings Stadium Bond Lawsuit Thrown Out by Minnesota High Court - January 22, 2014 by Mr HomeBuilder

    Minnesotas top court threw out a legal challenge to the planned sale of $468 million in bonds to help pay for a new stadium for the National Football Leagues Vikings.

    The state supreme court said in an order issued yesterday that it lacked jurisdiction to hear the lawsuit filed by three Minneapolis residents on Jan. 10.

    Led by one-time Minneapolis mayoral candidate Doug Mann, the petitioners said the stadium plan unconstitutionally relied upon city sales taxes to pay the bond debt. Minnesota postponed a sale scheduled for Jan. 13 after the challenge was filed.

    The statute under which Mann and the others sued does not confer original jurisdiction on the court to resolve all challenges to legislation authorizing the use of appropriation bonds, six members of the court said in an unsigned ruling. The courts seventh member, former Vikings defensive tackle Alan Page, didnt participate in the case.

    The justices said the residents could file a lower-court case raising a constitutional challenge to a matter involving taxation, without expressing an opinion on whether such a claim could be successfully litigated. A suit filed by Mann against the Minneapolis City Council was rejected by a lower court in November and again yesterday by a three-judge panel on the states intermediate-level Court of Appeals.

    I will consider my appeal options in the lawsuit against the city, decide whether to take further action within a few days, Mann said yesterday in an e-mailed statement.

    Given the stance taken by the Supreme Court on the writ of prohibition, and amazingly quick action by both the Supreme Court and the Court of Appeals, a request for review by the Supreme Court seems unlikely to be granted, he said.

    The constitutionality of the laws authorizing the sale wasnt at all addressed, he said.

    In asking the Supreme Court for a dismissal last week, Jim Schowalter, commissioner of the states Department of Management and Budget, said there was no constitutional violation.

    MMB and the states financial team are turning to selling the necessary bonds to keep the stadium project on track and all the Stadium Authority to make timely payments on construction and land acquisition agreements, Schowalter said in a statement issued after yesterdays rulings.

    Westdale Mall’s demolition due to deterioration, need for change - January 21, 2014 by Mr HomeBuilder

    When the demolition of Westdale Mall begins later this spring, it will become part of a national trend of redeveloping hundreds of formerly vibrant retail centers.

    Green Street Advisors of Newport Beach, Calif., has forecast that 10 percent of the nations 1,000 enclosed malls will fail by 2022. Many will be partially or totally demolished, converted to uses with significantly less retail.

    Another report from CoStar Group of Washington, D.C., shows more than 200 malls with over 250,000 square feet have vacancy rates of 35 percent or higher. Age also appears to be a contributing factor as 86.5 percent were built before 2000.

    Westdales deteriorating physical condition and the need to create a radically different mixed-use destination are cited as reasons for tearing down the majority of the 35-year-old mall by Frew Development Group of Denver, Colo., which is overseeing a $90 million redevelopment of the property.

    During a recent tour of the central portion of Westdale, buckets filling with water from a leaking roof and skylights were abundant. A service corridor that the public never sees showed ample evidence of structural settling and damage to the buildings infrastructure.

    The damage to the mall has resulted from decades of neglect, said John Frew, president of Frew Development Group. The 10-year roof that was installed 20 years ago could be replaced, but the concerns we have are water penetration to the electrical boxes and conduit, much of it running under the mall.

    The front wall of the mall was not built on compacted soil and it has settled more than six inches. That is putting stress on pipes passing through the wall, causing horizontal cracks to form.

    You finally have to ask yourself Do we put more lipstick on the pig, or do we start from scratch?
