Town officials are looking for ways to make it more difficult for owners of landmarked houses to demolish any portion of those homes without permission.
Ideas include requiring owners to obtain a separate permit for demolition work, and finish that work, before they are issued a building permit to restore or reconstruct landmarked homes. Demolition work now is included within the scope of building permits.
The ideas were outlined in a Sept. 24 memo from Planning, Zoning and Building Director John Page to the Landmarks Preservation Commission. The board is expected to consider them on Oct. 16 and might make recommendations to the Town Council, Page said Wednesday.
The issue arose following the partial demolition of the landmarked house at 105 Clarendon Ave. Some of the demolition was done without approval from the landmarks board. The town issued a stop-work order on Sept. 4.
Then, on Sept. 17, the landmarks board decided to allow crews to take down the remaining faade and proceed with replicating the house, which is part of Vita Serena. It made that decision after hearing from project architect Harold Smith and structural engineer Albert Gargiulo that decaying wood-frame walls, termite infestation and extensive water damage made preservation impossible. The board accepted Smith and Gargiulos recommendation to complete the demolition and construct a true replica, but members also said proper procedure was violated when workers took down a section of the house without approval.
That situation at 105 Clarendon prompted staff to look for ways to prevent a similar mishap, Page said. The inventory of town landmarks constitutes a valuable cultural asset, he said. Preservation of that asset is a cornerstone of the landmarks ordinance.
Page said he will consult with Town Attorney John Randolph about the procedure for reviewing proposed changes. One question is whether they need to be studied by the councils Ordinances, Rules and Standards Committee or can go straight to the council.
The changes would apply only to landmarked structures.
Under the procedure outlined in the memo, an initial permit would be issued specifically for demolition work, not the remaining work associated with renovation or restorations. Once the demolition portion is completed, within the scope approved by the landmarks board, the town would issue a demolition completion certificate, the memo said. Only then could property owners obtain the permits required to accomplish the restoration or reconstruction portion of their projects.
If any additional demolition should prove necessary, it could not occur unless approved by the town in advance, according to the memo.
