NEW DELHI: Attorney general Mukul Rohatgi on Tuesday cleared the decks for CBI to chargesheet former telecom minister Dayanidhi Maran for allegedly forcing Aircel owner C Sivasankaran to sell his firm to Malaysian business tycoon T Ananda Krishnan in return for huge investments into the Maran family owned Sun TV in 2006.
The Supreme Court-monitored CBI investigation into the 2G spectrum scam included the alleged coercion of Sivasankaran to sell his stake to Krishnan. The probe had reached Malaysia and tax havens like Isle of Man and British Virgin Islands.
After completing the investigation, and despite certain documents being denied by Malaysian authorities, CBI had informed the court in its status report that it had sufficient evidence to proceed against Maran. The opinion of the investigating officer was endorsed by a four-tier scrutiny of evidence, culminating with the agency's director of prosecution.
However, CBI director Ranjit Sinha wanted the opinion of then attorney general G E Vahanvati whether the evidence gathered by the agency would stand scrutiny in court. Showing the rule book, Vahanvati returned the file and said the AG's opinion could be sought only when there was a difference of opinion between the director of prosecution and the CBI director.
The CBI director than wrote his opinion on the file saying he felt the "prosecutable" evidence against Maran was weak. This difference of opinion between the CBI director and the director of prosecution necessitated the AG's opinion.
After going through the evidence and the opinions attached with the file, Rohatgi said he saw no reason to disagree with the opinions of the investigating officer and others, up to the director of prosecution, which were expressed after taking into account the evidence collected by the agency.
NGO 'Centre for Public Interest Litigation', through counsel Prashant Bhushan, had filed documents before the 2G scam probe monitoring bench in 2011 alleging that Maran had thwarted Sivasankaran-owned Aircel's repeated pleas for grant of mobile services licences from 2004 to 2006, forcing the owner to sell his stake at a discounted price to Maxis Group owned by Malaysian tycoon T Ananda Krishnan.
It had alleged that Aircel was shown favours shortly after the change in ownership. "In November 2006, DoT issued 14 LoIs to Aircel, and all of them were converted into licences in December 2006. Within three months of this, Maran's family-owned business (Sun TV) received substantial investment from Maxis Group (Aircel) by taking just 20% equity in Sun Direct which did not have much business at that time," the NGO had alleged.
Maxis Group invested Rs 599.01 crore in Sun Direct between December 2007 and December 2009, in addition to another investment of Rs 111 crore in the FM radio operations controlled by the Maran group, it had alleged.

Marking a major milestone in the development of the Kollam Port, imported raw cashew consignments will start arriving here by ship from mid-September. The cashew kernels will also be exported from the Kollam Port.
This was announced by Minister for Ports K. Babu after attending a high-level meeting with officers of the Ports Department, V.O. Chidambanar (Tuticorin) Port authorities, and representatives of the Cashew Export Promotion Council of India and Kollam-based cashew industry here on Monday.
Kollam port will become qualified for handling import and export consignments after being allocated with the Electronic Data Interface Number required for online Customs clearance and establishment of a permanent VAT office at the port complex.
The Minister said that the port would get these two facilities by August end.
Addressing the media, Mr. Babu said Mondays talks paved the way for a formal tie-up between the Tuticorin and Kollam ports.
Through the tie-up, imported raw cashew consignments arriving at Tuticorin will be transferred to Kollam-bound ships without being unloaded and cleared from the Tuticorin Port complex. The same facility will be available for exports.
At present, the imported raw cashew consignment required for the cashew sector in and around Kollam arrives from various countries at the Tuticorin and Kochi Ports and from there to Kollam by road in container trucks.
The Minister of Ports said that the cashew sector would be eligible for the subsidy announced for transporting goods through coastal shipping.
Director of Ports P.I. Shiek Pareeth said that 36,000 containers carrying raw cashew arrived in Kollam annually. When the new arrangement became operational, the Kollam Port would become very active, he said.
Mr. Babu said that moves were on to draw the Indian Rare Earths and Kerala Minerals and Metals Limited to use the Kollam port for their exports.

SINGAPORE - Work has begun on enhancements for Pang Sua Pond in Bukit Panjang, one of the 16 stormwater collection ponds here, with a groundbreaking ceremony at Senja-Cashew Community Club on Sunday morning.

A boardwalk that enhances connectivity between the Pang Sua Pond and the neighbouring amenities, two lookout decks that provide a panoramic view of the waters, and a multi-purpose stage for performances by the water - these are what residents can look forward to when the Pang Sua Pond undergoes a makeover under PUB's Active, Beautiful, Clean Waters (ABC Waters) Programme.
Guest-of-Honour Dr Vivian Balakrishnan, Minister for the Environment and Water Resources and Adviser for the Holland-Bukit Timah GRC, unveiled the upcoming ABC Waters project at a groundbreaking ceremony this morning.
A new boardwalk around the Pang Sua Pond is set to become a community focal point, connecting residents to facilities in the vicinity such as the Senja-Cashew Community Club, Bukit Panjang Neighbourhood 5 Park and the future 3G Wellness Centre. Elevated above the water, the boardwalk brings residents closer to water so that they can better enjoy this precious resource.
PUB will also be building two lookout decks that offer panoramic views of the waterfront and a multi-purpose stage for outdoor performances. When completed, the new features will integrate seamlessly with the Community Club, blending in with the tranquil and picturesque surroundings.
The Pang Sua Pond, located south of the Bukit Panjang Neighbourhood 5 Park, is a stormwater collection pond that collects runoff from the surrounding areas before it is pumped to the Upper Seletar Reservoir for storage.
As part of the transformation, PUB and the National University of Singapore (NUS) with Deltares will be test-bedding a new ABC Waters design feature - in-stream wetlands. To be located at the mouth of the adjoining Pang Sua East Canal, the trial will test the effectiveness of in-stream wetlands in treating the dry weather flow1 before it drains into the pond.
Together with the floating wetlands that will be constructed in the Pang Sua Pond, these ABC Waters design features will help to cleanse water naturally using plants, while beautifying the surrounding landscape and enhancing biodiversity. To further improve water quality in the Pang Sua Pond, aerators and a recirculation system will be installed.
