Basement remodeling contractor sued by state - July 11, 2014 by Mr HomeBuilder

Ohio Attorney General Mike DeWine today announced a lawsuit against Quality 1st Home Improvements LLC and its owner, Tony Logan, for violations of Ohio's consumer laws.

In the lawsuit, the Attorney General seeks restitution for consumers, civil penalties, and an injunction to stop further violations.

This contractor repeatedly failed to make good on his promises to consumers, DeWine said. The purpose of the lawsuit is to obtain restitution for the affected consumers and to bring the business into compliance with Ohios consumer laws.

Tony Logan operates Quality 1st Home Improvements from Grove City. The business offers home improvement services, specifically basement remodeling, by going door to door, soliciting consumers at their homes.

Five consumers filed complaints against the business with the Ohio Attorney Generals Office or the Better Business Bureau. In two cases, consumers paid the business upfront to refinish their basement, but they were left with partially finished work. Collectively, the two consumers lost more than $16,800. Through informal dispute resolution, Logan promised to reimburse the consumers but failed to do so.

The Attorney General's lawsuit, filed in the Franklin County Court of Common Pleas, charges the business and its owner with violations of Ohio's Consumer Sales Practices Act and Home Solicitation Sales Act. Specific counts include failure to deliver, performing shoddy work, and failing to give consumers notice of their three-day right to cancel.

Complaints about household goods and property improvement consistently rank among the top five consumer complaints filed with the Ohio Attorney Generals Consumer Protection Section.

To protect themselves, consumers should research a home improvement contractor before making any payments. Consumers can check for complaints with the Ohio Attorney Generals Office and the Better Business Bureau. They also can conduct a basic Internet search and ask for and contact references.

Consumers who believe they have been treated unfairly should contact the Ohio Attorney Generals Office at 800-282-0515 or http://www.OhioAttorneyGeneral.gov.

How to select a contractor for design-build - July 6, 2014 by Mr HomeBuilder

Last week, we began a discussion on a type of construction philosophy and practice known as the design-build process. Rather than having one group (owners and architect) create a set of construction documents and a different group (contractors) provide a budget, this process puts all interested parties on the same team beginning with the design phase and continuing through construction.

This process integrates the concepts of design and budget in order to create a project that results in maximum design with minimal budget discrepancies. This is not an easy process, and it requires understanding and good communication skills on the part of all involved.

How do you select a contractor without any plans to bid out? First, you need a list of three or four possibilities. You find these by talking to friends and neighbors, checking out websites and getting recommended names from your architect. Contact each builder and set up an appointment at your home. At this meeting, you can show them the house and discuss in general terms what you think you may do such as dig out the basement, add a second story, put an addition on the back, update the curb appeal, etc. In turn, you will gather information from the contractor relative to the companys history, remodeling experience, availability and general markup.

After checking out their references, you need to make a decision as to which contractor you think would work with you best. It is a little bit like dating; good chemistry is useful for a good remodeling project.

So, here is a summary of the process so far:

    1. Meet with an architect to discuss your wants and wishes, your goals and visions for your home.

    2. While your architect is developing the master plan, begin interviewing contractors.

    3. Select a contractor.

    4. The team (homeowners, architect and contractor) meet together to review the master plan and the contractor provides a budget estimate. This is not a bid, but a range of projected costs based on reasonable assumptions.

At this point, the structural requirements are not determined, and the finishes have not yet been selected. The contractor must use the preliminary plans and his experience to provide a reasonable cost for the major line items of a remodel, such as concrete, framing, windows, flooring, cabinets, etc. "Range of cost" is the key concept here, as much remains to be determined.

Shake Shack in park to temporarily close, get overhaul - July 1, 2014 by Mr HomeBuilder

The long Shake Shack lines in Madison Square Park are about to disappear the original location will be closing for five months so the kiosk can get a much-needed makeover.

Not to worry, though the planned upgrades are expected to be completed during the winter and wont impact the summer burger season.

Planned much-needed improvements at the hip burger joints kiosk at Madison Square Park include expanding the kitchen-prep area and making room for more storage in the basement, said rep Edwin Bragg in a statement.

Shake Shack is footing the bill for the update that will slightly expand the shacks size to allow for more food prep space and provide the basement with more storage.

We never dreamed of the enduring impact Shake Shack would have as a beloved community gathering place and iconic New York institution for locals and visitors from around the globe, said Shake Shack CEO Randy Garutti.

We are humbled and proud to have played a role in transforming Madison Square Park into a thriving destination and neighborhood hub.

The Chelsea location was the burger joints first restaurant. They now have 10 locations throughout the city.

The original location of the wildly popular fast food-and-shakes chain just celebrated its 10th anniversary last month.

To mark the occasion, Michelin-starred chef Daniel Boulud served specially designed burgers to devotees who waited up to an hour and a half in the rain to buy them.

Shake Shack started as a hot-dog cart in the park in 2001 and three years later, it expanded into the kiosk.
