CHENNAI: A special court in Chennai on Tuesday declined to remand three persons, including an aide of former Union telecom minister Dayanidhi Maran, in police custody saying the CBI had not clearly stated the reasons for their custody.
The CBI arrested the former Union minister's additional private secretary V Gowthaman, chief technical officer of Sun TV Network S Kannan and TV group's electrician K S Ravi on January 21. The charge against them was that they aided and abetted the laying of BSNL telephone lines to the minister's residence here and helped in its misuse by Sun TV Network.
The other accused in the case are Maran and two former chief general managers of BSNL.
On Friday, the agency sought their custody for five days. On Tuesday, special judge for CBI cases J Krishnamoorthy rejected the agency's plea saying it had not given proper reason for their custody.
Pointing out that the three had appeared before the CBI for several sessions of inquiry, the judge said their further custody could not be ordered.
Earlier, counsel for the accused argued for their bail, saying their arrests were unjustified since they had been cooperating with investigation officers all these years.
Electrician Ravi's counsel R C Paul Kanagaraj set the ball rolling by saying the case pertained to the alleged illegality between 2004 and 2007, and that the complaint surfaced in 2008.
Noting that since then all concerned had been summoned several times and inquiries held, Kanagaraj said the central agency had started arresting people on specious ground that they failed to cooperate with the agency.
He said that due to aggressive telecom policy, the mobile penetration had increased in India, while call rates had plummeted. Arresting people belonging to a private organization, that too when the main suspect himself had no case against him, was not proper, he added.
The judge said he would pass orders on the bail pleas of the trio on Wednesday.

A final City Council report issued Monday on two controversial demolition projects and code enforcement urges the city to get rid of political influence in city operations.
"It is paramount that considerations for all members of the community are taken as the number one priority over the few who may have access or connection to City Hall," the report concludes.
City Council President Rodney Wiltshire said the city must wring out the politics that impede good service and transparency. Council Robert Doherty said that "political shenanigans" must come to an end instead of dominating city discourse and policies.
The report doesn't find criminal fault for the acts surrounding the demolition of 4-10 King St. in August 2013, the demolition work at King Fuels site in 2013 and 2014 or the closing of 51 Third St. by code enforcement in 2014.
But, the reports asserts, "... the absence of any such claims shall not imply that criminal wrongdoing did not occur." The report further notes that other agencies the U.S. Environmental Protection Agency and FBI are investigating the demolition activities.
Wiltshire said the council has sought action by the administration to deal with problems, but that none has occurred.
The report comes after six hearings were held from April through September 2014 about the demolition work and code enforcement.
The report reviews the events surrounding King Street, King Fuels and 51 Third St. and makes recommendations to improve communications and oversight by the city administration in demolition and code enforcement.
"I will look at the report. I want to see what they say," Mayor Lou Rosamilia said.

A CITY Government official is optimistic that the court will rule on the motion it filed in favor of the residents in barangays Puntod and Macabalan who are facing the prospect of being displaced from their homes due to a demolition order that is supposed to be executed today.
Teddy Sabugaa, City Social Welfare and Development (CSWD) chief, said that based on his recent conversation with Judge Arthur Abundiente, the presiding judge of Regional Trial Courts Branch 25, he believes the latter will give weight on the motion to extend the date of the demolition.
He was very open to the City Governments request. Committed siya, he told Sun.Star Cagayan de Oro by phone Tuesday, referring to the motion filed by City Hall to have the demolition be deferred at a later time.
Humanitarian reason
He said Abundiente has considered City Halls motion for humanitarian reason.
Sabugaa acted as the representative of Mayor Oscar Moreno, while lawyer Edgar Cabanlas is the legal counsel for the City Government.
In a previous interview with Sun.Star Cagayan de Oro, Cabanlas said the motion City Hall filed last Friday, on behalf of the would-be dislocated residents, was for the court to consider on the students who will be affected if the demolition would be executed during school days.
Cabanlas said Moreno has requested the Court 90 days extension or during the summer vacation when the children are off from school.
The three-month period would give the City Government enough time to scout relocation for the dozens of families that will eventually be displaced when the demolition is executed.
It can be recalled that on January 23, hundreds of members of Cagayan Integrated Landless Residents Association Incorporated (Cilrai) staged a protest rally at the National Housing Authority (NHA)-Northern Mindanao in Barangay Puntod to ask for the agencys intervention that could delay the demolition.

NORTH ADAMS >> Two old buildings on West Main Street have been razed and demolition work continued Monday on a third, on Hall Street.
It was expected to cost a total of $162,400 to demolish the structures at 24-26 West Main St., 408 West Main St. and 94-96 Hall St. Fairly extensive asbestos abatement and the precarious position of the Hall Street structure, which sits on a small cliff, inflated costs and prolonged the labor.
Jay Mor Enterprises LLC of Pelham, N.H., is performing the work. The city paid the contractor with fiscal 2013 Community Development Block Grant funds, supplemented by a small amount of fiscal 2014 CDBG money.
The Office of Community Development keeps a running list of roughly 30 properties up for demolition. Mayor Richard J. Alcombright and Community Development Director Michael Nuvallie said the city chose these particular buildings out of need.
"We want to have the best possible impact on the community," Alcombright said.
"We try to go after the buildings in the worst shape," Nuvallie said.
The Hall Street structure ate up the majority of the total cost, at $90,900. "We owed it to the neighborhood," Alcombright said, noting that residents had waited 15 years for the city to remove it.
