Some neighborhood activists have claimed the residential demolition issue is the next street fee.
By that they mean a controversy the City Council will have a hard time resolving because it pits impassioned citizens against powerful special-interest groups upset neighbors and historic preservation advocates on one side, and developers on the other.
But now it seems the two issues have something else in common: last-minute changes to proposals being considered by the council.
The Bureau of Development Services has proposed several code changes in response to growing neighbor outrage over the increasing number of older homes being torn down and replaced with one or more new houses. The council had a hearing on the proposal on Dec. 17 that was continued to Feb. 12 because so many people had signed up to testify.
But BDS now wants to amend its original proposal to address complaints raised at the first hearing. And like the shifting street fee proposals, many of the original critics are not satisfied with the new changes, either.
The original proposal included a mandatory 35-day delay on all demolitions and increased neighborhood notification requirements. But BDS also wanted to end an existing 120-day delay automatically granted to neighborhood associations who request it. That change was opposed by preservationists and United Neighborhoods for Reform, a grassroots organization that formed over the summer around the demolition issue.
Among other things, UNR wants the council to appoint a citywide task force to consider a wider range of demolition-related issues, including limiting the size of the replacement homes to maintain neighborhood character.
The new BDS proposal would still end the existing 120-day delay. However, it would allow a 60-day delay to be added to the mandatory 35-day delay if anyone requests it stretching the total potential delay to 95 days.
The new proposal also would require that whoever requests the delay pay a $1,318 fee, submit a plan for saving the property, and prove they have the financial means to carry it out.
United Neighborhoods for Reform met Sunday evening to review the amendments. According to co-founder Al Ellis, the group reluctantly agreed to accept the 90-day delay and requirement for a plan showing how the property can be saved.

Demolition controversy continues
RESIDENTS who are facing imminent demolition will hold a protest rally in front of the National Housing Authority (NHA)-Northern Mindanao in Barangay Puntod today (January 23) to bring out their grievances on the looming demolition of their houses in barangays Puntod and Macabalan on Saturday.

Pagayaman told Sun.Star Cagayan de Oro by phone Thursday that their occupation in the area is legal, but that the writ of demolition the NHA on December 12 and 17, 2014 showed to the residents is also legal.
The demolition order is intended for lots 1 to 7 located in the two barangays.
Kadamay alleged the NHA-Northern Mindanao officials who brought the order were accompanied by representatives from two companies who have an interest in the contested area.
Pagayaman said the affected residents, who banded together and call themselves the Cagayan Integrated Landless Residents Association Incorporated (Cilrai), are ready to fight a legal battle against NHA, as he cited a provision of a law that supposedly protects them.
According to him, Article 1, Section 2 (b) (2) of Republic Act, also known as the Urban Development and Housing Act of 1992, says, Equitable utilization of residential lands in urban and urbanizable areas with particular attention to the needs and requirements of the privileged and homeless citizens and not merely on the basis of market forces.
Because of this law, Pagayaman said, whatever program the government undertakes must prioritize the needs of the poor and not just the private sector.
He said they will also question the NHA-Northern Mindanao, which the group alleged sold the lots to the two companies, why the agency did not hold a dialogue 30 days prior to the issuance of the writ of demolition.
Cilrai, he added, also want a relocation site, complete with basic facilities, for the affected families, if ever they will be driven out of their homes.

The City Council's findings on controversial demolition and code enforcement actions will not recommend criminal investigations, but criticizes city administrative operations for jeopardizing residents, according to a draft report obtained by the Times Union.
The City Council will issue a final report next week based on its investigation of the 2013 demolition of 4-10 King St. and 2014 demolition work at the King Fuels site and closing 51 Third St. by code enforcement in 2014.
"The Troy City Council makes no claim of criminal fault in any of these situations," a copy of the draft report states.
"It is noted that other qualified agencies are conducting external investigations into the legality of certain city processes and any criminal activity surrounding these events," the report states.
U.S. Environmental Protection Agency and FBI agents have received copies of the testimony and have been interviewing city employees about the demolition projects.
What comes across in the draft report is the council's frustration at the lack of oversight in certain government activities.
The draft report notes the council "was thwarted at times and ... that information was being deliberately hidden or manufactured in order to sell a story or bolster a certain testimony."
The draft report found there was no communication within the administration ranks, that department heads stretched their powers and that public safety and rights were threatened at the three sites.
"There is no active communication between the administration and the departments that involve in these issues," City Council President Rodney Wiltshire said Thursday.
