Montvale's first tree ordinance, which the borough council was slated to adopt at its Feb. 11 council meeting, was tabled that evening to be further reviewed by professionals.
The ordinance, which was drafted by a committee that Councilwoman Leah LaMonica assembled last summer, proposes to prohibit clear-cutting in the borough by means of limiting the number of trees residents are allowed to cut down in certain residential zones. The proposed ordinance covers three zones - R-10, R-15 and R-40 - and residents are allowed to cut down three, four and five trees in those respective zones with a $35 permit. For any tree removed thereafter, residents would be given the option of replacing it or paying $500. A $2,000 fine is planned for violators of the law.
The governing body introduced the ordinance at its Jan. 14 meeting and then sent it to the Montvale Planning Board for review. At a recent planning board meeting, the board engaged in a thorough discussion of the ordinance, with most voicing concerns over the chosen zones, permits and fines. Planning Board Chairman John DePinto, who was present at Tuesday's council meeting, told the governing body his recommendations, which were outlined in the agenda packet. Among them was adding multi-family and commercial zones, one of which includes a heavily forested commercial property on Chestnut Ridge Road used for residential purposes.
Planning Board Planner Richard Preiss, who DePinto said has experience with tree ordinances, will review the proposed ordinance with other professionals and make recommendations to the planning board.
At the public hearing that evening, a few residents voiced their own concerns about the ordinance. John Worth, a resident who lives in a "heavily forested" property in the R-40 zone, said the proposed number of trees he would be allowed to cut from his property is "not a workable number."
"Someone like me is severely limited with five trees a year," he said, adding that he thinks the ordinance is "uncalled for" and "not necessary."
Kathy Cullen, another borough resident, was in favor of the ordinance. She said, however, that she did not like the fact that there is no mention of commercial properties in the ordinance. In regard to the tree removal aspect of the ordinance, which states that one must either pay $500 or replace a tree after exceeding the limit, she asked if the council would consider planting a different tree species in its place to enhance the beauty in the borough.
Robert Hanrahan, president of the tree ordinance committee who helped draft the ordinance, implored the council to include the opinions of residents along with the professionals when revising the draft.
LaMonica said the revised ordinance will be in the best interest of all the residents.
"There's work to be done in it," she said.

After 50 plus years of use, the tile in the football team showers at Minnesota State University Moorhead was worn and dingy and the concrete floor was badly discolored. Edward Spearman, his Atlanta-based tile import business shut down by an ice storm yesterday, did about the only thing he could do. He plopped down on a cushy sofa in front of a warm, split-wood fire with his 5-month-old son in his lap and answered e-mails -- in between tickles.
Dit, dit, dit, dit, dit, Spearman, 46, dressed in sweats and a long-sleeve t-shirt, said to the cooing baby after setting aside his device for a moment.
He wasnt at home. Spearman was part of an exodus Tuesday night to hotels like the Ritz-Carlton in Buckhead, metro Atlantas swank business epicenter. They were fleeing what were expected to be mass power outages from ice-encased tree limbs crashing onto electric lines.
