A Northern California family who watched a retaining wall give way and crush their 9-year-old son to death in Lassen Volcanic National Park several years ago has settled with the federal government for $3.5 million.
During a family outing in 2009, Tommy Botell Jr. was sitting on a wall near a hiking trail with his sister when it collapsed. Sections of the wall fell on them as the two children tumbled about 30 feet and their parents struggled to grab them.
"Mommy, I can't see," Tommy told to his mother as he died in her arms, according to the Sacramento Bee.
The wall had deteriorated and rolled over Tommy and crushed his brain stem.
Perceived unethical conduct clouded the lawsuit filed on behalf of Botell's family. At one point, U.S. Magistrate Judge Gregory G. Hollows said park Supt. Delores Koontz did not fix the wall despite knowing it was dangerous, and then tried to cover up her mistakes after Tommy Botell's death.
"This was a horrific event that no family should have to endure. Our grief and loss were compounded by the refusal of the Park Service to accept responsibility and to act responsibly during the lawsuit," according to a family statement issued through an attorney.
Nonetheless, U.S. Atty. Benjamin Wagner said that "as the settlement agreement indicates, it is in no way intended to be, and should not be construed as, an admission of fault or wrongdoing on the part of Park Service employees."

With the Rajya Sabha putting its seal of approval on the Bill for creating Telangana amid bedlam, the birth of the 29th State of the Union is just a presidential signature away.
The historic development was preceded by prolonged labour pangs beginning from July 30 last year, the day the Congress Working Committee (CWC) approved a resolution for bifurcation of Andhra Pradesh.
On Wednesday, there was a great deal of anxiety about the fate of the State as the BJP, which had helped the government push through the Bill in the Lok Sabha on Tuesday, put a spanner in the works by insisting that without a Constitution amendment it faces the danger of being legally challenged.
But, thanks to hectic backroom negotiations at the highest level of the government and the BJP, it was smooth sailing in the Upper House despite protests from Seemandhra MPs, who parked themselves in the Well of the House throughout the day with banners and placards. Prime Minister Manmohan Singh and his team of Ministers succeeded in persuading top BJP leaders not to press for a Constitution amendment, which would have complicated the process.
Mr. Singhs team convinced the BJP brass that the government was on sound legal footing on giving special powers to the Governor over safety and security of the residents of Hyderabad, which will be the joint capital for a maximum of 10 years.
It was the understanding between the government and the BJP which prompted CPI(M) leader Sitaram Yechury and all others who opposed the Bill to describe it as a classic case of match-fixing.
At the meeting, it was agreed that the Prime Minister would announce a package to address the concerns of the Seemandhra people as well as those in the backward regions of Telangana.
Intervening in the debate in the Rajya Sabha, the Prime Minister announced that for the purposes of Central assistance, special category status would be extended to the successor state of Andhra Pradesh for five years. He said the Centre would take steps to offer tax incentives to promote industrialisation and economic growth in both States.
In addition, a special development package for the backward regions of the successor state of Andhra Pradesh, in particular the districts of Rayalaseema and north-coastal Andhra Pradesh, will be given on the lines of the K-B-K (Koraput-Bolangir-Kalahandi) Special Plan in Odisha and the Bundelkhand special package in Madhya Pradesh and Uttar Pradesh.
Speaking about the commitment of his party to creating Telangana, Leader of the Opposition Arun Jaitley expressed dismay over the manner in which the UPA had handled the entire issue.

New Delhi: India on February 20, 2014 got its 29th state, but not before a day-long debate in Parliament and a decades-long struggle for it. The Andhra Pradesh Reorganisation Bill 2013, which seeks to bifurcate the southern state into Telangana and Seemandhra, was passed by Rajya Sabha on Thursday, days after it was adopted by Lok Sabha.
After prolonged debate and continued disruptions, the Upper House adopted the Bill through a voice vote, despite many amendments being moved by the Opposition Bharatiya Janata Party, all of which were defeated.
The Prime Minister assured the Opposition that Hyderabad will be a joint capital of the two regions for a period of 10 years and Seemandhra will get financial packages to grow stronger. Seemandhra, which is the combined area of Rayalaseema and Coastal Andhra Pradesh districts, will also get the Special Category status for five years.
A 6-point development package is also on the cards for the region, the PM said in a statement amidst din in the House. Trinamool Congress MPs led By Derek O'Brien tore papers and threw at him as he made his speech. Congress leaders stepped forward and made a protective ring around him.
The session in the Rajya Sabha saw continuous protests with the House being adjourned six times since the Bill was tabled on Thursday afternoon.
BJP leader Venkaiah Naidu moved several amendments as the Bill was put to a voice vote at the end of the session. The TMC and the CPM, which were opposed to the Bill, refused to move amendments, confining themselves to protesting in the Well of the House. As the Bill was put to vote, CPIM MP Sitaram Yechury announced his party was staging a walkout.
As the Telangana Bill was adopted, celebrations began in the region. Telangana Rashtra Samithi leader KT Rama Rao said, "We are extremely happy. Seemandhra people don't need to worry. They will be treated with the same respect and protected."
Home Minister Sushil Kumar Shinde said, "It's a gift to the people of Telangana. The BJP and the BSP also supported the Bill."
Not all were happy, however. Derek O'Brien said the government did not pay heed to the party's opposition. "We had given in writing the objection we had and the government did not want to hear us."

An apartment complex in Gresham, Oregon was having a mold crisis said its residents. A report from koin.com dated February 19, 2014 related the details of it. And in response, My Cleaning Products suggested two mold removal sprays to help the public make the remediation process fast and safe.
